RESOLUTION NO. 5983
A RESOLUTION GRANTING PERMIT UNDER SECTION 14-124.102(2)
OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING
TO PERMIT EXPANSION AND MODIFICATION OF THE KNOLLWOOD
SHOPPING CENTER FOR PROPERTY LOCATED IN THE PLANNED UNIT
DEVELOPMENT DISTRICT AT THE NORTHWEST CORNER OF HIGHWAY 7
AND TEXAS AVENUE
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. United National Corporation and Minnesota Teachers Realty Corporation
has applied to the City Council for a special permit under Section 14-124.102(2)
of the St. Louis Park Ordinance Code for the purpose of permitting expansion
and modification of the Knollwood Shopping Center for property located in a
Planned Unit Development District located at the northwest corner of Highway 7
and Texas Avenue for the legal description as follows, to -wit:
That part of the south half of the southeast quarter of Section 18,
Township 117 North, Range 21 West, Hennepin County, Minnesota,
lying north of State Trunk Highway 7 and east of the following
described line: Beginning at the northwest corner of said south
half of the southeast quarter; thence south along the west line
of said south half of the southeast quarter 87.45 feet; thence
deflecting to the left 71 degrees, 1 minute, 30 seconds, and
running southeasterly 325.2 feet; thence deflecting to the right
50 degrees, 47 minutes, 30 seconds and running southeasterly
262.1 feet; thence deflecting to the left 27 degrees, 12 minutes,
and running southeasterly 954.12 feet more or less to a point in
the northerly right-of-way line of State Trunk Highway 7, excepting
therefrom that part of said south one-half of the southeast quarter
described as follows: Beginning at the northeast corner of said
south one-half of the southeast one quarter; thence running west
along the north line of said south one-half of the southeast one
quarter 783 feet; thence south parallel with the east line of
said south one-half of the southeast one quarter 499.55 feet;
thence east parallel with the north line of said south one-half
of the southeast quarter 783 feet more or less to a point in the
east line of said south one-half of the southeast one quarter;
thence north along said east line 499.55 feet more or less to
the point of beginning; also excepting that part lying within
the right of way of Texas Avenue; and except all that part of
the above-described premises conveyed to the City of St. Louis
Park for street purposes by deed recorded in Office of Hennepin
County, Minnesota, Register of Deeds as Document No. 2964984,
for Aquila Avenue.

2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 77 -26 -SP) and the effect of the proposed
shopping center expansion and modification on the health, safety and wel-
fare of the occupants of the surrounding lands, existing and anticipated
traffic conditions, the effect on values of properties in the surrounding
area, the effect of the use on the Comprehensive Plan, compliance with the
intent of the Zoning Ordinance, and consistency with the Final General PUD
Plan.
3. The Council has determined that the proposed modification and
expansion of the shopping center will not be detrimental to the health,
safety, or general welfare of the community nor will it cause serious
traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed expansion and modification to the Knoll -
wood Shopping Center is in harmony with the general purpose and intent of
the Zoning Ordinance, the Comprehensive Plan, and the Final General PUD
Plan.
Conclusion
The special permit to permit the expansion and modification of Knollwood
Shopping Center at the location described is granted based on the findings
set forth above and subject to the following conditions:
1. That the site be developed, used, and maintained in accordance
with the following exhibits except as modified below: Exhibit
A, Site Plan -Landscape Plan; Exhibit B, Detail Landscape Plan
Sheets S2 and S3 plus a plan berming the landscape area to be
brought back to the Council for its review and consideration
prior to issuing a building permit; Exhibit C, Elevation Plan;
Exhibit D, Sign Plan; and a drainage plan acceptable to the
City shall be submitted.
2. An additional 13 feet be dedicated along the west side of
Texas Avenue for the upgrading of Texas Avenue as shown on
the Texas Avenue Alternative IIA, as modified providing 24
feet between the curb line and westerly edge of the setback
area if the street were widened to 52 feet.
3. That Contingency Plan A be included as Exhibit E providing
for the future modification of Texas Avenue to provide a
left turn lane and channelization at the proposed new
entrance on Texas Avenue in the event that Alternative IIA
is not sufficient or that Texas Avenue be redesigned at the
entrance to prevent vehicular left turn ingress and egress
from Texas Avenue.
4. There shall be no outside storage of trash except in the
utility court yard located at the east end of the center.

5. Parking lot lights on the east and northerly sides of the
proposed mall shall not be more than 35 feet in height
measuring from the parking lot grade to the top of the
luminaire.
6. An automatic public safety alarm system to detect burglary
or intrusion, meeting the City public safety requirements,
shall be installed or a full-time security person shall be
employed to keep the building secure during hours which the
center is closed.
7. Sales shall not be conducted out of doors unless specific
approval is granted by the City Council, and such sales
shall not last for more than three days nor more than
twelve days in any single calendar year.
8. The construction of the mall, additional shops and Wards
shall be constructed simultaneously.
9. With respect to the stone wall constructed by the applicant
adjacent to 36th Street, the applicant agrees to hold the
City harmless in connection with the City maintenance, repair
or reconstruction of public utilities adjacent to West 36th
Street.
10. Provide the following fire safety:
a. Repair all existing fire walls and separations.
b. Fire alarms to be installed according to NFPA.
c. Smoke and heat detection alarms are to be installed
in existing areas.
d. Install an automatic fire extinguishing system in the
entire center, both new and existing, or provide a
deluge system to provide a water curtain between
existing and new development and install an automatic
fire extinguishing system in the entire new portion.
e. If basement areas are to be used for retail (in old
section), such areas shall have an automatic fire
extinguishing system.
11. The developer shall provide evidence of insurance for
indemnification of surrounding property owners against
subterranean damage to structures caused by construction.
12. All improvements, including landscaping, buildings, parking
lot construction and roadways in the Wards area shall be com-
pleted by October 15, 1979; all other facilities shall be
completed by October 15, 1980.
