RESOLUTION NO. 5981
AUTHORIZING TAKING OF LAND BY EMINENT DOMAIN
FOR WATER MAIN AND SANITARY SEWER EASEMENT
WHEREAS, the City Council has ordered preparation of a resolution
authorizing taking of land by eminent domain and the City Engineer has
recommended the acquisition of land for water main and sanitary sewer
easement purposes at the locations hereinafter specified, and it appears
to the Council that it is necessary that the City acquire such lands,
therefore •
BE IT RESOLVED by the City Council of St. Louis Park:
1. That it is hereby determined that the taking of each of the
tracts and parcels of land set forth in paragraph 3 hereof is necessary
for the public good in order that said tracts and parcels shall be devoted
to water main and sanitary sewer easement purposes.
2. That the City shall take by right of eminent domain for
water main and sanitary sewer easement purposes the lands described in
paragraph 3 hereof, and the City Attorney be hereby authorized and
directed to commence proceedings in the District Court of Hennepin County
for appointment of Commissioners to determine the damages, if any,
sustained by the respective owner of the parcels affected by such taking,
as authorized by law, and
3. That the lands above referred to are more particularly described
as follows:
An easement for water main purposes over and across the Great Northern
Railway right of way in the South 1/2 of the Southwest Quarter of
Section 7, Township 117, Range 20, 20 feet wide being 10 feet on either
side of the following described line: Commencing on said Northerly
right-of-way line. 555 feet more or less East from the West line of said
Southwest Quarter to the Southerly right-of-way line at a point 595 feet
more or less East from the West tine of said Southwest Quarter and therr
terminating.
A temporary construction permit over and across the Great Northern
Railway right of way in the South 1/2 of the Southwest Quarter of
Section 7, Township 117, Range 21, being the outer 10 feet of a 20 -foot
strip on both sides of the following described line: Commencing on
said Northerly right-of-way line 555 feet more or less East from, the West
line of said SouthwestQuarter to the Southerly right-of-way line at a
point 595 feet more or less East from the West line of said Southwest
Quarter and there terminating.
An easement for sanitary sewer purposes over and across the Great Northern
Railway right of way in the South 1/2 of the Southwest Quarter of Section
7, Township 117, Range 20, 20 feet wide being 10 feet on either side of the
following described line: Commencing on said Northerly right-of-way line
608 feet more or less East from the West line of said Southwest Quarter to
the Southerly right-of-way line at a point 648 feet more or less East from
