RESOLUTION NO. 5960
A RESOLUTION GRANTING PERMIT UNDER SECTION 14-123.10
OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING
TO PERMIT CONSTRUCTION OF A SINGLE FAMILY HOME IN THE
F-2 FLOODPLAIN DISTRICT AT 4801 WEST 26TH STREET
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Jack L. Baumgarten has made application to the City Council for
a special permit under Section 14-123.10 of the St. Louis Park Ordinance
Code for the purpose of constructing a single family home in the F-2 Flood-
plain District located at 4801 West 26th Street for the legal description
as follows, to -wit:
Lot 1, Block 1, Friedberg Addition
2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 78 -1 -SP) and the effect of the proposed
construction of the single family home in the F-2, Floodplain District, on
the health, safety and welfare of the occupants of the surrounding lands,
the effect on the modification of the floodplain, existing and anticipated
traffic conditions, the effect on values of properties in the surrounding
area, the effect of the use on the Comprehensive Plan and the official
map and compliance with the intent of the F-2, Floodplain District.
3. The Council has determined that the construction of the single
family home in the F-2, Floodplain, will not be detrimental to the health,
safety, or general welfare of the community nor will it cause serious
traffic congestion nor hazards, nor will it adversely affect the storage
capacity of the floodplain, nor will it seriously depreciate surrounding
property values, and the proposed construction of a single family home
in the F-2, Floodplain District, is in harmony with the general purpose
and intent of the Floodplain District and the Comprehensive Plan.
Conclusion
The special permit to permit construction of a single family home in the
F-2, Floodplain District, at the location described is granted based on
the findings set forth above and subject to the following conditions:
1. The lowest floor elevation of the structure shall be
at 876' mean sea level.
2. The site shall be graded in accordance with the Grading
Plan designated Exhibit A and prepared by Egan, Field,
and Novak, Inc.
3. The home constructed on the site shall be constructed in
accordance with plans labeled Exhibit B consisting of five
sheets and prepared by John A. Kinsell, Architect, dated
January 18, 1978.
4. All improvements on the site including construction of the
proposed home and site grading shall be completed by June 1,
1979.
5. The proposed subdivision known as Friedberg Addition shall
be filed with Hennepin County prior to the granting of any
building permits on the site.
