HomeMy WebLinkAbout4847 - ADMIN Resolution - City Council - 1978/11/06November 6, 1978 9f RESOLUTION NO. b 11 6 5 A RESOLUTION AMENDING RESOLUTION NO. 4847 ADOPTED June 18, 1973, GRANTING PERMIT UNDER SECTION 14-150(3)(e) OF THE ORDINANCE CODE TO PERMIT A MOTOR FUEL STATION FOR PROPERTY LOCATED IN THE B-1 BUSINESS DISTRICT AT 6011 EXCELSIOR BOULEVARD. BE IT RESOLVED BY the City Council of St. Louis Park: Findings 1. Holiday Station Stores, Inc. has made application to the City Council for amendment to an existing special permit under Section 14-150(3)(e) of the Ordinance Code for the purpose of permitting additional pump islands at a motor fuel station for property located at 6011 Excelsior Boulevard for the legal description as follows, to -wit: 6011 Excelsior Boulevard; Lot 2, Brookside Subdivision No. 2, except the following: Commencing on the northeast corner of said lot; thence southerly along the easterly line of said lot 72 feet; thence westerly parallel to the southerly line of said lot 16.5 feet; thence parallel to the east line of said lot to the northerly line thereof; thence easterly along the northerly line of said lot to beginning; Lots 3 and 4, Brookside Subdivision No. 2. 2. The City Council has considered the advise and recommendation of the Planning Commission (Case No. 78 -108 -SP) and the effect of the proposed motor fuel station on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding areas and the effect of the use on the Comprehensive Plan, and complaince with the intent of the Zoning Ordinance. 3. The City Council has determined that the proposed amendment to the existing special permit to permit a motor fuel station will not be detrimental to the health, safety or general welfare of the community, nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed motor fuel station is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. r Conclusion The special permit to permit the additional pump island at the existing motor fuel station at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed, used, and maintained in accordance with Exhibits A, B and C as provided for in Resolution No. 4847 and, in addition, pump island modifications are permitted in accordance with Exhibit E, Revised Site Plan. 2. A six -foot -wide easement for pedestrian circulation and landscaping shall be provided along Excelsior Boulevard at such time as the improvement of Excelsior Boulevard occurs. 3.
