RESOLUTION) NO. 5917
A RESOLUTION GRANTING PERMIT FOR A SPECIFIED PERIOD
OF TIME UNDER SECTION 14-156(6) OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO, PERMIT AN OUTpOOR
STORAGE AND RENTAL AREA TO CONTINUE FOR TWO YEARS FOR
PROPERTY LOCATED IN THE B-2 DISTRICT AT 4909-4911
EXCELSIOR BOULEVARD
BE IT RESOLVED by the City Council of the City of St. Louis Park:
Findings
1. John E. Fitzgerald has made application under Section 14-156(6)
for the purpose of continuation of an outdoor storage and rental area
located at 4909-4911 Excelsior Boulevard for the legal description as
follows, to -wit:
Lot 3, Block 5, Minikanda Vista
2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 77 -59 -SP) and the effect of the proposed
continuation of an outdoor storage and rental yard on the health, safety,
and welfare of the occupants of the surrounding lands, existing and anti-
cipated traffic conditions, the effect on values of properties in the
surrounding area, the effect of the use on the Comprehensive Plan, and
compliance with the intent of the Zoning Ordinance.
3. The Council has determined that the proposed continuation of the
outdoor storage and rental yard will not be detrimental to the health,
safety or general welfare of the community nor will it cause serious
traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed continuation of the outdoor storage and
rental yard is in harmony with the general purpose and intent of the Zoning
Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit the continuation of the outdoor storage and
rental yard for a period of two years at the location described is granted
based on the findings set forth aboveiand subject to the following conditions:
1. The curb cut on Quen,ti,n ;Avenue shall be narrowed to
32' and the boulevard"and setback area landscaped
in accordance with the"sketch plan labeled Exhibit A.
2. A 6' high opaque wooden fence shall be constructed beginning
at a point 15' east of the property line on Quentin Avenue
and extending to the east property line along the southerly
property line and then extending north to the rear of the
existing building and then extending west to the southeasterly
corner of the existing building.
3. The outdoor storage and rental area shall be removed by
January 1, 1980, and no additional outdoor storage or
rental areas shall be permitted thereafter.
4. A report on the status and compliance of the site with the
conditions of this permit shall be provided to the Planning
Commission every six months during the effective period of
this resolution.
5. The requirements of Exhibit A, including the revised curb
cut and installation of fence and landscaping of the front
and side of the lot abutting on Excelsior Boulevard and
Quentin Avenue, shall be completed by June 10, 1978.
