HomeMy WebLinkAbout5890 - ADMIN Resolution - City Council - 1977/11/07P-1 RESOLUTION NO. 5890 RESOLUTION AMENDING RESOLUTION NO. 5728 ADOPTED MAY 2, 1977 GRANTING PERMIT UNDER SECTION 14-136(4) and 14-195(3) OF THE ORDINANCE CODE TO PERMIT CLUSTER HOUSING FOR 38 UNITS FOR PROPERTY LOCATED IN THE R-3 DISTRICT AT 7501 WEST 22nd STREET BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Centurion Co., Inc. has made application to the City Council for an amendment to an existing special permit under Section 14-136(4) and 14-195(3) of the St. Louis Park Ordinance Code for the purpose of constructing a cluster housing development of 38 units for property located in the R-3 district at 7501 W. 22nd Street for the legal description as follows, to -wit: Lot 5, Home Addition 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 77 -64 -SP) and the effect of the proposed amendment to the 38 unit cluster housing development on the health, safety, and welfare of the occupants of the surrounding lands, existing and antici- pated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the existing special permit to permit a cluster housing development of 38 units will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed cluster housing development of 38 units is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a cluster housing development of 38 units at the location described is granted based on the findings set forth above and subject i to the following conditions: 1. The site be developed, used, and maintained in accordance with Exhibit A, Site Plan; Exhibit B, Preliminary Grading & Drainage Plan; Exhibit C, Preliminary Utilities Plan; and Exhibit D, Modified Landscape Plan. 2. The fence along the west property line shall be of a solid material that is completely opaque and of redwood or equivalent material. It should be constructed prior to commencement of building on the site unless the residents in the 2200 block of Pennsylvania Avenue request a modification to this condi- tion prior to construction of the fence. 3. All trash facilities shall be stored inside the garage or other inside spaces except for setting the trash out when necessary. 4. All improvements, including construction of buildings, utilities, paving, and landscaping and usable open space facilities, shall be constructed by October 1, 1979. 5. The design of the berm shall be in a manner and of a material that will retain moisture in order to maintain quality ground cover, sod, and trees on the berm. ATTEST: 8,J.
