HomeMy WebLinkAbout5874 - ADMIN Resolution - City Council - 1977/10/17A RESOLUTION NO. 5874 A RESOLUTION GRANTING PERMIT UNDER SECTION 14-123(2) OF THE ORDINANCE CODE TO PROVIDE FOR THE CONSTRUCTION OF A SINGLE FAMILY HOME IN THE R-1 DISTRICT AND IN THE F-2 FLOOD PLAIN DISTRICT FOR PROPERTY LOCATED ON LOT 6, BLOCK 1, HILLSBORO OAKS, COMMONLY KNOWN AS 3172 HILLSBORO AVENUE SOUTH. Findings 1. William Putnam has made application to the City Council for a special permit under Section 14-123(2) of the St. Louis Park Ordinance Code for the purpose of constructing a single family home in the F-2 Flood Plain District located at 3172 Hillsboro Avenue South for the legal description as follows, to -wit: Lot 6, Block 1, Hillsboro Oaks 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 77 -54 -SP) and the effect of the proposed con- struction of a single family home in the Flood Plain District on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan and com- pliance with the intent of the Zoning Ordinance and the effect on the flood plain of Minnehaha Creek. 3. The City has referred the request to the State Department of Natural Resources for a period of at least ten days, and the State Department of Natural Resources has not responded negatively to the request. It is deter- mined that permitting construction of the single family home in the F-2 District will not have a negative effect on the flood plain of Minnehaha Creek nor will the flood waters have a negative effect on the proposed structure when constructed in accordance with the conditions listed below. 4. The Council has determined that the construction of a single family home in the F-2 ,District will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor will it seriously depreciate surrounding property values, and the pro- posed single family home construction is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. r Conclusion The special permit to permit construction of a single family home in the F-2 Flood Plain District at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The first floor and lowest livable floor of the structure shall not be lower than 913.9' M.S.L. 2. The garage floor may be at an elevation not lower than 905' M.S.L. 3. There shall be no utilities of any kind below the flood protection elevation of 909' M.S.L. 4. Section 14-123.10(2)(j) of the Ordinance Code shall not apply to the proposed structure in that compliance would result in the flooding of adjacent properties and would have an adverse effect on the flood plain.
