RESOLUTION NO. 5872
A RESOLUTION AMENDING RESOLUTION NO. 5795 ADOPTED
AUGUST 15, 1977, PROVIDING FOR A VARIANCE IN LOT
WIDTH FROM SECTION 14-128(5) OF THE ORDINANCE CODE
RELATING TO ZONING TO PERMIT A LOT WIDTH OF 70' IN
THE R-1, SINGLE FAMILY DISTRICT, AT 2619, 2623, AND
2627 SALEM AVENUE SOUTH UNDER SPECIFIED CONDITIONS.
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
\ 1. Hill F. Sweet has applied for a variance from Section 14-128(5) of the
Ordinance Code relating to zoning to permit the combination and division of
existing lots to permit three single family lots of 70 feet in width located
in the R-1 Single Family District at the following location, to -wit:
Lots 18 and 19, Block 1, Oak Lawn Addition and Lots 7, 8, 9,
and the southerly 5' of Lot 10, Block 1, Blakeman's 3rd Addi-
tion, together with that part of the West 1/2 of vacated alley
adjoining said lots.
2. The Board of Appeals has reviewed the application for a variance
(Case No. 77 -33 -VAR) and has reported its action to the City Council.
3. The Council has considered the effect of the proposed variance upon
the health, safety, and welfare of the community; existing and anticipated
traffic conditions; light and air; danger of fire; risk to the public safety;
and the effect on the values of property in the surrounding area and the effect
of the proposed variance on the Comprehensive Plan and the intent of the Zoning
Ordinance.
4. Because the above-described parcels of land are the last remaining vacant
pmrcels in the above-described block, it is possible to divide the subject pro-
perty in such a way that the land is efficiently utilized in a manner which most
closely represents the intent of the Zoning Ordinance by providing lots having a
width of 70' instead of the required 75'. Granting the proposed variance will
not impair an adequate supply of light and air to adjacent property, unreasonably
increase the congestion in the public streets, increase the danger of fire,
endanger the public safety, unreasonably diminish or impair health, safety,
comfort, and morals or in any other respect be contrary to the intent of the
Zoning Ordinance and the Comprehrensive Plan.
5. The width of the subject parcel is peculiar to such property and does
not apply generally to other land or structures in the R-1 District in that the
subject parcels are adjacent lots of record which cannot be built upon separately
but which can be combined and divided in such a manner to provide for the most
efficient development of the land that is in accordance with the intent of the
Zoning Ordinance.
6. The granting of the application is necessary for the preservation and
enjoyment of a substantial property right of the applicant. It will not merely
serve as a convenience to the applicant but is necessary to alleviate a demonstrable
hardship or difficulty in the use of the individual lots.
7. The following conditions and safeguards are necessary in order to insure
and will in fact insure that there will be no unreasonably adverse consequences
to the granting of the variance:
a. The property shall be combined and divided in accordance
with Alternative A designating three lots of 70' in width.
b. Single family homes constructed on the site shall be con-
sistent with the requirements of the Zoning Ordinance in
terms of yard setback areas, floor area ratio, building
height, and required off-street parking.
Conclusion
The application for a variance for the purpose designated is granted based on the
findings set forth above and subject to the conditions set forth in Paragraph No. 7
of these findings.
