RESOLUTION NO. 5863
RESOLUTION ESTABLISHING WORDING
FOR PROPOSED CHARTER AMENDMENT
Whereas, the duly appointed Charter Commission for the City
of St. Louis Park has delivered to the city clerk the proposed
amendments to Sections 2.03, 2.05, and 3.01 of the Home Rule Charter;
and
Whereas, the proposed amendments shall read in their entirety
as follows:
Section 2.03, Paragraph 2. Elective Officers.
The term of the Mayor and of each Councilman shall begin

Hext-fe4lew4mg-194s-e3eet+en the first regularly scheduled meeting in
the month following the month in which the regularly scheduled municipal
election is held, as specified in 4.02 of this Charter, and shall end
when his successor has been duly elected and has qualified. The Council
shall be the judge of the election of its members.
Section 2.05, Vacancies in the Council. A vacancy in the
Council shall be deemed to exist in case of the failure of any person
elected thereto to qualify on or before the date of the second regular
meeting of the new Council, or by reason of the death, resignation,
removal from office, removal from the City, removal of a ward councilman
from his ward, continuous absence from the City for more than three
months, or conviction of a felony, of any such person whether before
or after his qualification, or by reason of the failure of any councilman
without good cause to perform any of the duties of membership in the
Council for a period of three months. In each such case, the Council
shall forthwith by resolution declare such vacancy to exist and appoint
an eligible person to fill the vacancy. The term of the person so
appointed shall extend to the-f4est-Menday-after-the-f4rst-Tuesday-411

scheduled meeting in the month following the month in which the regularly
scheduled municipal election is held, as specified in 4.02 of this Charter,
provided that if such vacancy occurs less than 120 days prior to the next
regular City or State election, and the unexpired term extends more than
one year, the term of the person so appointed shall extend to the -forst

the-vaeaeey the first regularly scheduled meeting in the month following
the month in which the regularly scheduled municipal election is held,
as specified in 4.02 of this Charter. If such a vacancy occurs 120 days

or more prior to a regular State election, the Council shall call a
special election to be held concurrently with the State election within
the City, if the office is Mayor or Councilman at Large, and within
the ward affected, if the office is a Ward Councilman, for the purpose
of electing an eligible person to fill the unexpired term following
expiration of the term of the person appointed by the Council in the
interim.
Section 3.01, Council Meetings. On the-f4°st-Menday-after-the
f4est-Tuesday-}m-daeuary-fe44ew4mg-a-regu4ar-fae4e4ga4-e4eet}ee, the
first regularly scheduled meeting in the month following the month in
which the regularly scheduled municipal election is held, as specified
in 4.02 of this Charter, the Council shall meet at the City Hall at
the usual time for the holding of Council meetings. At this time
the newly elected members of the Council shall assume their duties.
Thereafter the Council shall meet at such times as may be prescribed
by resolution, except that they shall meet at a fixed time not less
than once a month. The Mayor or any three members of the Council may
call special meetings of the Council upon at least twelve hours' notice
to each member of the Council. Such notice shall be delivered personally
to each member or be left at the member's usual place of residence with
a person of suitable age and discretion then residing therein, or written
notice thereof shall be left in a conspicuous place at the residence if
no such person be found there. The presence of any member of the Council
at a special meeting shall constitute a waiver of any formal notice
unless he appears for the special purpose of objecting to the holding
of such meeting. The Council may provide by ordinance a means by which
a minority may compel the attendance of absent members. All meetings of
the Council shall be public and any person shall have access to the
minutes and records thereof at all reasonable times. The Mayor and each
Councilman shall have one vote.
BE IT RESOLVED BY THE CITY COUNCIL OF ST. LOUIS PARK, MINNESOTA:
1. Pursuant to Minnesota Statutes, Section 410.12, Subdivision
4, at the general election held in the usual polling places in the City
on the 8th day of November, 1977, from 7:00 A.M. to 8:00 P.M., the follow-
ing proposition shall be posed:
"Shall the proposed new charter amendment, changing
the commencement of the term of the offices of Mayor
and Councilman to the first regularly scheduled Council
meeting in December be adopted?

2. The city clerk shall prepare the necessary ballots and
other election supplies, give proper notice, and arrange other details
necessary for the election.
