A RESOLUTION GRANTING VARIANCE IN FRONT YARD SET BACK
FROM SECTION 14-128(5) OF THE ORDINANCE CODE RELATING
TO ZONING TO PERMIT A FRONT YARD SETBACK OF 15' FOR A
PARKING LOT IN THE R-1 DISTRICT AT 7624 CEDAR LAKE ROAD
UNDER SPECIFIED CONDITIONS.
BE IT RESOLVED BY the City Council of St. Louis Park, Minnesota:
Findings
1. Peace Presbyterian Church has applied for a variance from Section 14-128(5)
of the Ordinance Code relating to zoning to permit a front yard setback for a
parking lot of 15' for a church located in the R-1 District at the following
location, to wit:
Lots 12-19, Block 1, Westwood Hills First Addition
2. The Board of Zoning Appeals has reviewed the application for a variance
(Case No. 77 -41 -VAR) and has recommended to the City Council that the appli-
cation to permit a front yard of 15' for a parking lot be granted with conditions
on the basis that the size and shape of the parcel creates a hardship in the
laying out of an adequate number of parking stalls.
3. The Council has considered the effect of the proposed reduction in
front yard setback for the parking lot upon the health and safety and welfare
of the community, existing and anticipated traffic conditions on the street
and generated from the site, the effect of reductions in light and air to
adjacent property, danger of fire, risk to the public safety, and the effect
of the parking lot on the values of property in the surrounding area and the
compatibility of granting the variance in relation to the intent of the
Comprehensive Plan and the Zoning Ordinance.
4. Because of the unusual size and shape of the parcel and the location
of the existing church building and if the site is developed with the following
conditions, it is possible to use the subject property in such a way that the
proposed variance will not impair an adequate supply of light and air to
adjacent property, unreasonably increase the congestion in the public streets,
increase the danger of fire, endanger the public safety, unreasonably diminish
or impair health, safety, comfort, morals, or in any other respect be contrary
to the intent of the Zoning Ordinance or the Comprehensive Plan.

5. The unusual size, shape, and development of the parcel in question
is peculiar to such property and does not apply generally to other land or
structures in the district in which such land is located.
6. The granting of the application is necessary for the preservation
and enjoyment of a substantial property right of the applicant. It will not
merely serve as a convenience to the applicant but is necessary to alleviate
a demonstrable hardship in the use of the property.
7. The following conditions and safeguards are necessary in order to
insure and will in fact insure that there will be no unreasonably adverse
consequences to the granting of the variance:
a) The site shall be developed in accordance with Exhibit A,
Site Plan and in addition, a hedge shall be installed and
maintained at approximately 42" in height along the inside
of the parking lot curb on Quebec Avenue and Pennsylvania
Avenue.
Conclusion
The application for a variance to permit a front yard setback for a parking lot
of 15' is granted, based on the findings set forth above and subject to the
condition set forth in paragraph 7 of these findings.
