HomeMy WebLinkAbout5805 - ADMIN Resolution - City Council - 1977/08/15r f Q AUGUST 15, 1977 11• RESOLUTION NO. j 8 5 RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR STORM SEWER EASEMENT WHEREAS, the City Council c,t St. Louis Park has authorized and directed the Acting City Manager to negotiate with Park National Bank tor the acquisition of the easement to the land hereinafter described, for public uses, and WHEREAS, Park National Bank, pursuant to such negotiations, has indicatedtheirdesire to donate said property to the City by Quit Claim Deed at no cost, now therefore BE IT RESOLVED by the City Council ot St, Louis Park that the City ot St- Louis Park acquire from Park National Bank the following described easement in Hennepin County, Minnesota, to -wit: An easement for drainage and storm sewer in and over chat part ot the following described two tracts: Tract 1 - The West 190 feet of that part ot the Northwest Quarter of the Southwest Quarter lying East of the West 40 feet and North ot a line bearing North 88°29'58" East from a point in the West line of the Northwest Ouarter ot the Southwest Quarter distant 268.05 feet South of the Northwest corner of said Northwest Quarter of the Southwest Quarter, Section 30, Township 29, Range 24. For the purpose ot this description the Wcst line ot said Northwest Quarter of the Southwest Quarter is assumed to bear due North and South. Tract 2 - That part of the Northwest Quarter ot the Southwest Quarter lying West of the East 20.87 acres thereof, except the West 40 feet of said tract, in Section 30, Township 29, Range 24, hereinafter called "che above- described property", lying North of the rollowing described line: Commencing at the Southeast corner of the above-described property; thence Notth along the East line of the above-described property 705.21 tees to the point ot beginning of the line to be described; thence at a right angle West to the West line of the above-described property and there terminating except the South 76.46 feet thereof, and except that part of the West 190 feet of the above-described property lying North of a line bearing North 88'29'58" East from a point in the West line of said Northwest Quarter of the Southwest Quarter, distant 268.05 feet South of the Northwest corner of said Northwest Quarter of the Southwest Quarter. For purpose of this description, the West line of said Northwest Quarter of the Southwest Quarter is assumed to bear due North and South. Said easement is described as follows: Commencing at the Northwest corner of the Northwest Quarter of said Southwest Quarter, thence East along the North line of said Northwest Quarter for a distance of 680 feet; thence South along a line perpendicular to said North line tor a distance of 95 feet; thence along a line in a Southwesterly direction to a point on the West line of said Northwest Quarter distant 130 feet South of the Northwest corner of the Northwest Quarter of the Southwest Quarter as measured along said West line; thence Notth along said West line to point of beginning and there terminating. Except that part of the above easement lying within state and/or city right of way; and the Mayor and Acting City Manager are hereby authorized to execute any and all instruments necessary to complete the acquisition of said easement and the Acting City Manager is hereby authorized and directed to accept delivery o1 the deed from Park National Bank at no cost to the City. i 1 Attest: -2- Adopted by the City Council August 15, 177. 1 '�.
