RESOLUTION N0. 5778
A RESOLUTION AUTHORIZING THE TENDER OF
CERTAIN REAL ESTATE TO EMINENT DOMAIN
RESPONDENTS
BE IT RESOLVED by the City Council of the City of St. Louis Park that
the City Mayor and Acting City Manager are authorized to execute and tender
on behalf of the City a deed to Cardinal Insulated Glass Company or the
Almor Company which conveys the following described road right-of-way in
easement:
An easement for road right-of-way 16 feet wide being part of
Lots 26 and 27, Block 162, Rearrangement of St. Louis Park
lying west of a line drawn parallel to and 16 feet east of the
following described land:
That part of Lots 27 and 27, Block 162, lying within the
boundary line described as follows: Commencing at the north-
west corner of Lot 26, thence in an easterly direction along
the north line of Lot 26 for a distance of 25 feet to the actual
point of beginning of parcel to be described; thence continuing
in an easterly direction along the north line of Lot 26 for a
distance of 240 feet; thence in a southerly direction along a
line at right angles to said north line of Lot 26 to its
intersection with a line that is parallel to and 20 feet south of
the centerline of the Chicago and Northwestern Transportation
Company railroad tracks; thence along said parallel line in a
northwesterly direction to its intersection with the south lot
line of Lot 26, said intersection being located 127.10 feet
east of the southwest corner of said Lot 26 as measured along
said south lot line of Lot 26; thence in a westerly direction
along said south lot line for a distance of 97.10 feet; thence
along a line in a northerly direction to the point of beginning
and there terminating; except that part of said Lot 26 described
as follows: Commencing at the heretofore mentioned point of
beginning; thence in an easterly direction along said north line
of Lot 26 for a distance of 10 feet; thence along a line in a
southwesterly direction for a distance of 14.142 feet to a point
or line located 10 feet south of the point of beginning; thence
in a northerly direction to point of beginning and there termina-
ting.
Together with fee title and easement authorized in Resolution
5708 adopted April 4, 1977.

An easement for road right-of-way over that part of Lots
2, 8 and 9, Block 162 lying 12.5 feet on each side of a line
of the extension east of the southerly line of Lot 8 in said
Block extended east to the easterly line of said Lot 2. Also;
a strip of land 25 feet described as commencing 15 feet south
of the northeast corner of Lot 10; thence northeasterly at
right angles to the easterly line of Lot 10 to the easterly
line of Lot 2; thence southerly along the easterly line of Lot
2 a distance of 25 feet; thence southwesterly to a point in the
easterly line of Lot 10 25 feet south of the point of be-
ginning; thence northwesterly along said easterly line to the
point of commencement and there terminating. Also; the land
described under Fee Title in Resolution 5708 adopted April 4,
1977.
The above-described tender may be made at any time during the pendency
of the eminent domain action by the City of St. Louis Park against Cardinal
Insulated Glass Company and the Almor Company as set out in Resolution 5570,
adopted August 2, 1976, or during the appeal, if any, of said action or
within 30 days after the conclusion of said action and any appeal.
