A RESOLUTION REDEFINING AND NARROWING A STORM
' SEWER EASEMENT
BE IT RESOLVED by the City of St. Louis Park, Minnesota:
Findings
1. The City (then village) of St. Louis Park acquired in 1937, an
easement over and across all of Lot 26, Block 3, Surburban Homes Co.'s
Addition, commonly known as 4043 Yosemite Avenue for the purpose of exca-
vating, laying and construction thereon a storm sewer and retaining forever
the free right of using said sewer for the passage of sewage water.
2. The easement has caused a title problem for the current fee owners,
Mr. and Mrs. David J. Kemp, and they have requested that the easement be
narrowed and redefined to allow them to sell the property.
3. The water and engineering departments of the City have determined
that the easement need only be 16 feet either side of the location of the
sewer pipe as now located.
4. Since the pipe is 16 feet below the surface, retention of a 32 -foot
easement allows the City to continue to have a one-to-one slope ratio which
is desirable from an engineering and safety standpoint.
5. The approximate,location of the sewer pipe is'on the south lot line
of the property.
6. The Council has determined that the redefining and narrowing of the
easement to 16 feet either side of the center line of the location of the
'sewer pipe will not adversely affect the maintenance of the storm sewer and
will allow Mr. and Mrs. Kemp to sell their property.
Conclusion
The Mayor and Acting City Manager are authorized to execute on behalf of
the City the necessary documents to redefine and narrow the storm sewer ease-
ment over, under and across the south 16 eet of Lot 26, Block 3, Suburban
Homes Co.'s Addition.
