HomeMy WebLinkAbout5740 - ADMIN Resolution - City Council - 1977/05/161 MAY 16, 1977 RESOLUTION NO. 5740 RESOLUTION AUTHORIZING PURCHASE OF PROPERTY FOR STREET RIGHT CF WAY WHEREAS, the City Council of St. Louis Park has authorized and directed the City Manager to negotiate with Mary Elizabeth Kuempel, Jean Elizabeth Kuempel and Hugh Kuempel, each an undivided 1/3 interest, for the purchase of the fea title to the land hereinafter described for public uses, and WHEREAS, Mary Elizabeth Kuempel, Jean Elizabeth Kuempel and Hugh Kuempel, each an undivided 1/3 interest, pursuant to quch negotiations, have indicated their desire to sell said property to the City by Warranty Deed for the sum of $',500, now therefore BE IT RESOLVED by the City Council of St. Louis Park that the City of St. Louis Park purchase from Mary Elizabeth Kuempel, Jean Elizabeth Kuempel and Hugh Kuempel, each an undivided 1/3 interest, the following described property in Hennepin County, Minnesota, to wit: All of that part of Lot 4 in Block 42, St. Louis Park Center, described as follows: Commencing at the Couthwest corner of said Lot 4; thence East along the Southerly line„ -of said lot a distance of 90 feet; thence North and parallel with the East line of said Lot 4 a distance of 50 feet; thence West and parallel with the South line of said lot to Thirty-sixth Street; thence in a Southwesterly direction along the North- westerly boundary of said lot with 36th Street to the North- westerly corner of said lot; thence South along the West line of said lot to the point of beginning, according to the plat thereof on file and of record in the office of the Tiegister of Deeds, in and for Her+neNr. itin+ie5ota and the Mayor and Ctty Manager are hereby authorized to execute any and all instruments necessary to complete the purchase of said property and the City Manager is hereby authorized and directed to accept delivery of the deed and to pay the sum of $7,500 from the General Fund to said Mary Elizabeth Kuempel, Jean Elizabeth Kuempel and Hugh Kuempel, each an undivided 1/3 interest, as the purchase price of said property upon the delivery to him of a Warranty Deed to said property accompanied by an Abstract of Title or Owner's Certificate of Title showing good and marketable title of record to said property, together with an opinion of the City Attorney of the City of St. Louis Park approving the execution of the deed and the seller's abstract or certificate.
