LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A RESIDENTIAL DEVELOPMENT UNIT CONSISTING OF CLUSTER HOUSING FOR PROPERTY LOCATED IN THE R-3 DISTRICT AT 7501 W. 22nd STREET BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings: 1, Centurion Co., Inc. has made application to the City Council for a special permit under Section 14-136(4) and Section 14-195(3) of the St. Louis Park Ordinance Code for the purpose of constructing a residential development unit consisting of cluster housing located at 7501 W. 22nd Street for the legal description as follows, to -wit: Lot 5, Home Addition 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 76 -72 -SP) and the effect of the proposed resi- dential development unit on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan. 3. The Council has determined that the residential development unit will not be detrimental to the health, safety or general welfare of -the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed residential unit is in• harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion: The special permit to permit a residential development unit consisting of cluster housing in the R-3 district at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site be developed, used, and maintained in accordance with Exhibit A, Site Plan, Landscape Plan; Exhibit 6, Preliminary Grading and Drainage Plan; Exhibit C, Prelimi- nary Utilities Plan. 2. The fence along the west property line shall be of a solid material that is completely opaque and of redwood or equivalent material. It should be constructed prior to commencement of buildings on the site, unless the residents in the 2200 block of Pennsylvania Avenue request a modification to this condition prior to construction of the fence. 3. All trash facilities shall be stored inside the garage or other inside spaces except for setting the trash out for pick up when necessary. 4. 'A11 improvements, including construction of buildings, utilities, paving, swimming pool, and usable open space facilities, and landscaping, shall be constructed by October 1, 1979.
