LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A RESIDENTIAL DEVELOPMENT UNIT FOR PROPERTY LOCATED IN THE R -B AND R-4 DISTRICT AT 4701 TO 4897 COUNTY ROAD 16 BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Richard Neslund, Centurion .Co., and Cheyenne Land Co. have made appli- cation to the City Council for a special permit under Sections 14-141(9),` 14-146(5), and 14-195(3) of the St. Louis Park Ordinance Code for the purpose of constructing a residential development unit consisting of'48 patio homes located at 4701 to 4897 County Road 16 for the legal description as follows, to wit: Thal_ part of the South half of the Southeast Quarter of Section 30, Township 29 North, Range 24 West, lying South of the center line of Cedar Lake Road, North of the Northerly right-of-way line of the Great Northern Railroad, and West of a line drawn parallel with and 392 feet East of he West line of said South Half of the Southeast Quarter. Also That part of the Southeast Quarter of the Southwest Quarter of Section 30, Township 29, Range 24, described as beginning at the intersection of the East line of said Southeast Quarter of the Southwest Quarter with the Northerly right-of-way line of the Great Northern Railway Company; thence Southwesterly 304.85 feet more or less, along said right-of-way line to the South line of said Southeast Quarter of the Southwest Quarter; thence West along said South line to a point thereon 726 feet East from the Southwest corner of said Southeast Quarter of the South- west Quarter; thence North parallel to the West line of said Southeast Quarter of the Southwest Quarter, to the Southeasterly line of County Road No. 16; thence Northeasterly along said Southeasterly line of County Road No. 16 to the East line of said Southeast Quarter of the Southwest Quarter; thence South 303.14 feet, more or less, along said East line to the point of beginning, according to the Government Survey thereof. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 76 -66 -SP) and the effect of the proposed resi- dential development unit on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan. 3. The Council has determined that the proposed residential development unit will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed resi- dential development unit is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a residential development unit consisting of 48 patio homes at the location described is granted based on the findings' set forth above and subject to the following conditions: 1. Tnis site shall be developed, used, and maintained in accordance with Exhibit A landscape plan, site plan, and grading plan except as modified by the following conditions: a. The ponding area shall be sodded and maintained as a landscape area and cleaned of debris as necessary to maintain the ponding capability and landscape nature. b. Each dwelling unit shall be provided with a separate water meter. c. The site work including construction of buildings, grading, paving, parking lot striping, and landscaping shall be completed by September 1, 1979.
