RESOLUTION NO. 5685
A RESOLUTION AMENDING RESOLUTION 3601 ADOPTED
SEPTEMBER 16, 1968 GRANTING PERMIT FOR COMMERCIAL
DEVELOPMENT UNIT FOR PROPERTY LOCATED IN THE B-2
DISTRICT GRANTING PERMIT UNDER SECTION 14-156(11)
OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO
ZONING TO PERMIT DRIVE -1N BANKING FACILITIES FOR
PROPERTY LOCATED IN THE B-2 DISTRICT AT 5219 WAYZATA
BOULEVARD
BE IT RESOLVED BY the City of St. Louis Park:
Findings
1. Park National Bank and MEPC American Properties have made application
to the City Council to amend Resolution 3601 adopted September 16, 1968 granting
permit for a Commercial Development Unit to provide for a special permit under
Section 14-156(11) of the St. Louis Park Ordinance Code for the purpose of
providing drive-in banking facilities for property located at 5219 Wayzata Boulevard,
for the legal description as follows, to -wit:
Tract A, D and E, Registered Land Survey No. 864; and that part
of the South 2 of the Southwest 4 of Section 30, Township 29,
Range 24, Hennepin County, Minnesota, lying West of the Westerly
right of way line of State Trunk Highway No. 100; lying.East of
the South extension of the West line of Registered Land Survey
No. 864, Files of the Registrar of Titles, County.of Hennepin;
and, lying northerly of the following described line: Beginn4ng at
the Southwest corner of said Registered Land Survey No. 864;
thence running Southerly along the South extension of the West
line of Registered Land Survey No. 864, a distance of 424.97 feet;
thence deflecting 89 degrees 28 minutes 06 seconds to the left
_and running Easterly to the Westerly right of way line of State
Trunk Highway No. 100, and there terminating.
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 77 -2 -SP) and the effect of the proposed drive-in
banking facilities on the health, safety and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on
valuei of properties in the surrounding area and the effect of the use on the
Comprehensive Plan.
3. The Council has determined that the drive-in banking facilities will
not be detrimental to the health, safety or general welfare of the community
nor will it cause serious traffic congestion nor hazards, nor will it seriously
depreciate surrounding property values, and the proposed drive-in banking
facilities are in harmony with the general purpose and intent of the Zoning
Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit drive-in banking facilities at the location described
is granted based on the findings set forth above and subject to the following
conditions:
a. The use be permitted for a period not to exceed five years;
however, the bank may request extension to this period if
merited.
b. The six reserved spaces designated on Exhibit A, Site Plan,
be retained during the period that the automatic teller
service is provided.
