RESOLUTION GIVING APPROVAL FOR FINAL PLAT OF WESTWOOD MANOR 5583 SEPTEMBER 7, 1976 WHEREAS, Richard Neslund, the owner and subdivider of the land proposed to be platted as Westwood Manor, has submitted an application for approval of final plat of said subdivision in the manner required for platting of land under the St. Louis Park Ordinance Code, and all proceedings have been duly had thereunder, and WHEREAS, said plat is in all respects consistent with the City Plan and the regulations and requirements of the Laws of the State of Minnesota and the ordinances of the City of St. Louis Park, and WHEREAS, said plat is situate upon the following described lands in Hennepin County, Minnesota, to -wit: Beginning on the East line of the Northwest Quarter of the Southwest Quarter of Section 5, Township 117, Range 21, 850 feet south of the Northeast corner thereof, thence West along the South line of 14th Street as shown in the plat of Turf and Paddock, 209.8 feet to the Northeast corner of Lot 21, Turf and Paddock, Hennepin County, Minnesota, thence South along the East line of said Lot 21 to the Southeast corner thereof distant 210 feet, thence East parallel with the north line of said Northwest Quarter of the Southwest Quarter to the east line thereof, thence North along the East line thereof to the South line of 14th Street, being the point of beginning. ALSO That part of the Northwest Quarter of the Southwest Quarter of Section 5, Township 117, Range 21, lying South of the South line of the plat of Turf and Paddock and East of the plat of Texas Terrace Third Addition. BE IT RESOLVED by the City Council of the City of St. Louis Park: 1. That said plat of Westwood Manor is hereby approved and accepted by the City as being in accord and conformity with all ordinances, City plans and regulations of the City of St. Louis Park and the laws of the State of Minnesota subject to the following conditions: (a) All gas, electric, water, sanitary sewer, and telephone utilities be placed underground, and i provided, however, that this approval is made subject to the approving opinion of the City Attorney as to the title and form and execution of the plat, the subdivider's bond, or the certificate of the City Treasurer certifying to a cash deposit in the amount required by the City Council as the estimated cost of improvements to be provided by the subdivider, as required by the provisions of Section 14-303(3)(e) of the St. Louis Park Ordinance Code entitled "Certification by City Clerk." 2. That the City Clerk is hereby directed to file a certified copy of this Resolution in the office of the Register of Deeds and Registrar of Titles for their use as required by M.S.A. 471.29. 3. That the City Clerk is hereby directed to supply a certified copy of this Resolution to the above named owned and subdivider, who is the applicant herein. 4. That the Mayor and City Manager are hereby authorized to execute all contracts required herein, and the City Clerk is hereby directed to execute the certificate of approval on behalf of the City Council upon the said plat when all of the conditions set forth in paragraph No. 1 above and Section 14-303(3)(e) of the St. Louis Park Ordinance Code have been fulfilled. 5. No dwelling units within the subdivision shall have a first floor or ground floor elevation less than 2 feet above the 100 -year flood plain. BE IT FURTHER RESOLVED that such execution of the certificate upon said plat by the City Clerk, as required under Section 14-303(3)(e), shall be conclusive showing of proper compliance therewith by the subdivider and City officials charged with duties above described and shall entitle such plat to be placed of record forthwith without further formality.
