A RESOLUTION AMENDING RESOLUTION 5317,EXTENDING COMPLETION
DATE ASPROVIDED FOR UNDER SECTION 6:205.5, GRANTING PERMIT
UNDER SECTIQN 6:122.15 OF THE ZONING ORDINANCE TO REMODEL
AND EXPAND EXISTING SERVICE STATION AND RETAIL STORE ON
PROPERTY LOCATED IN THE B-2 DISTRICT AT 7916 MINNETONKA
BOULEVARD
BE IT RESOLVED by the City Council of the City of St. Louis Park:
Findings
1. Erickson Petroleum Corporation has made application to the City Council
to extend the date of completion for a sPecial permit granted under Section
6:122.15 of the Zoning Ordinance for the purpose of remodeling and expanding an
existing service station and retail store at 7916 Minnetonka Boulevard, legally
described as follows:
Lot 7, Block 1, Texa Tonka 5th Addition
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 75 -39 -SP) and the effect of the proposed modifica-
tions to the existing use on the health, safety and welfare of the occupants of
the surrounding lands, existing and anticipated traffic conditions, the effect on
values of properties in the surrounding area and the effect of the use on the
Comprehensive Plan.
3. The Council has determine1 that the modification to the existing use to
remodel and expand the existing service station and retail store will not be
detrimental to the health, safety or general welfare of the community nor will it
cause serious traffic congestion nor hazards, nor will it seriously depreciate
surrounding property values and the proposed modifications to the use are in
harmony with the general purpose and intent of the Zoning Ordinance and the
Comprehensive Plan.
4. The Council has determined that conditions affecting the granting of the
special permit have not changed since the adoption of Resolution 5317.
Conclusion
The special permit to extend date of completion and to allow remodeling and
expansion of a motor fuel statiol,and retail store at the location described above
is granted based on the following conditions:
a) The site shall be developed, used and maintained in
accordance with Exhibit A, Site Plan/Landscape Plan; and
Exhibit B, Elevation Plans, as modified by the City
Planning Department on June 13, 1975, and as modified by
the conditions which follow.
b) That acceptable engineering drawings be submitted for
the retaining wall on the north side of the site, and said wall
must be architecturally treated with stucco, stone or other
decorative material.
c) That the plans for the landscape strip on the west side of
the site adjacent to Texas Avenue be submitted showing the
elevations and a cross section detail, and such plan must
be found to provide proper slope and drainage by the Director
of Public Works.
d) That the applicant provide sufficient space on the site for
relocation of the sidewalk and landscaping in connection with
the TOPICS -type modification and adjust the site plan
according to such plans including the provision for the
radius and driveway modification; however, any use of the
private property for sidewalk purposes can be included as
part of the required 8 -foot landscape area along the front
lot line.
e) All construction, demolition and building modifications,
paving, curbing, striping, landscaping and sign relocation
shall be completed by September 30, 1976.
