LOUIS PARK ZONING ORDINANCE FOR RESIDENTIAL DEVELOPMENT UNIT AND COM- MERCIAL DEVELOPMENT UNIT -- PARK CENTER ADDITION BE IT RESOLVED BY the City Council of St. Louis Park: Findings 1. Charles M. Freidheim Company has made application to the City Council for an amendment under Sections 6:176,2 and 6:176.4 of the Zoning Ordinance for the purpose of using land in the R -B and B-2 District for a Residential Develop- ment Unit and Commercial Development Unit for the legal description as follows: Park Center Addition. 2. The Council has considered the advice and recommendation of the Planning Commission (Case No. 76 -31 -SP and 76 -32 -SP) and the effect of the proposed use on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, including parking facilities on adjacent streets, and the effect on values of properties in the surrounding area, and the effect of the proposed use on the Comprehensive Plan, 3. The Council has determined the proposed use will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion, nor hazards, nor will it seriously, depreciate surrounding property values, and the same is in harmony with the general purpose and intent of this ordinance and the Comprehensive Plan. Conclusion The permit to amend the permit for a Residential Development Unit and Commercial Development Unit at the location described is granted based onthe findings set forth above and subject to the following conditions: 1. The site shall be developed, used and maintained in accordance with the following exhibits: Exhibit A, Park Center General Site Plan; Exhibit B, Final Plat of Park Center; Exhibit C, Drainage and Utility Plan; except as said exhibits may hereinafter be modified through conditions or new exhibits. 2. That the existing concrete block plant, block storage and associated facilities and uses be eliminated prior to December 31, 1972. 3. Before a permit shall be issued for any construction on any lot or lots included in the plant, an amendment tD this special permit which includes a detailed site and development plan for land to be included in such building permit must be approved by the City. Such detailed site plans must conform to the general site plan, Exhibit A. Land use component Exhibit "D", and the architectural form and treatment of proposed buildings shall take into account the architectural form and treatment of the structures in the area. 4. All electric, telephone or other wire or cable distributed services, gas, sewer, and water services shall be placed underground. 5. Lot 2 and Lot 3, Block 2 are limited to residential use. 6. All lots must be developed in accordance with the open space links and pedestrian ways extending from Wolfe Park through the site as shown on Exhibit "A". Each lot shall have access rights over those portions of the pedestrian system located on other lots and shall in turn provide access to the other lots. Proper easement agreements shall be provided when detail plans for development are presented. 7. Lot 1, Block 1, Park Center shall be constructed, used and maintained in accordance with Exhibit E; consisting of site plans, landscape plans, floor plans, and elevation plans, and numbered 1-11 and subject to pedestrian slope easement indicated on page 1, and in accordance with Exhibit "F", Block 1 General Plan; except as modified by the following conditions: a. That the well located near the northwest corner be abandoned following the proper procedure as set forth by the State Health Department and the Health Department of St. Louis Park. b. That the maximum total sign area of "Radisson Park" shall not exceed 330 square feet. c. That all roadways and parking islands be delineated by a concrete curb at least 6 inches high. -2- d. That all construction, landscaping, curbing, and all other features included on the 'Exhibits be completed by May 30, 1975, 8. That the General Site Plan, Exhibit A, shall be modified to include medically related residential facilities on the southerly portion of Lot 2, Block 2, Park Center. 9. That the following described property Parcel B, Exhibit L, Survey of Lots 2 and 3, Park Center be permitted to be developed for a residential Medical Treatment facility with the following conditions: a. The site shall be developed, used and maintained in accordance with Exhibit G, Site Plan; Exhibit H, Landscape Plan; Exhibit I, Sign Plan; Exhibit J, Elevation Plan; Exhibit K, Floor Plan; and Exhibit L, Survey. b. Plans for storm sewer, sanitary sewer, water, fire hydrants, acceptable to and approved by the City must be obtained prior to application for a building permit. c. All utilities shall be placed underground, d. In the event that real estate property taxes are abated or otherwise eliminated due to designation/'certification of the project as a nonprofit corporation not subject to real estate tax, a payment in lieu of taxes equal to the cost of City services shall be paid on or before the December 31 of each year commencing on December 31, 1977, and said cost to be $4,000 per year subject to an annual increase or decrease based on inflation on items related to the cost of such services, e. All buildings, structures, grading, paving, lighting, signage and landscaping shall be completed by June 1, 1977.
