RESOLUTION NO. 5537
A RESOLUTION GRANTING PERMIT UNDER SECTION 6:122.17 OF
THE ZONING ORDINANCE FOR MODIFICATION AND EXPANSION OF
CLASS I RESTAURANT FOR PROPERTY LOCATED IN THE B-2
GENERAL BUSINESS DISTRICT AT 5916 EXCELSIOR BOULEVARD
Be it resolved by the City Council of the City of St. Louis Park:
Findings
1. St. Louis Park Anchor Inn, Inc., has made application to the City Council
for a special permit under Section 6:122.17 of the Zoning Ordinance for the purpose
of modification and expansion of a Class I Restaurant located at 5916 Excelsior
Boulevard for the legal description as follows:
Beginning at the point of intersection of the north line of
Excelsior Avenue with the west line of the right of way of the
Minneapolis, Northfield and Southern Railway, then southwesterly
along the northerly line of Excelsior Avenue 150 feet, then at
right angles northwesterly 120 feet, then at right angles
northeasterly 40 feet, then at right angles northwesterly 18.5
feet to a point distant 170 feet at right angles from the east
line of Jackson Street, then north parallel with Jackson
Street 337.6 feet to the west line of the right of way of the
Minneapolis, Northfield and Southern Railway, then southeasterly
along said right of way 446.5 feet to the point of beginning.
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 76 -22 -SP) and the effect of the proposed modifications
to the existing use on the health, safety and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values
of properties in the surrounding area and the effect of the use on the Comprehensive
Plan.
3. The City Council has determined that the modification to the existing use
to permit expansion and modification of the existing facility will not be detrimental
to the health, safety or general welfare of the community nor will it cause serious
traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed modifications to the use are in harmony with the
general purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit modification and expansion of a Class I Restaurant
at the location described is granted based on the findings set forth above and
subject to the following conditions:
a) The site be developed, used and maintained in accordance with
Exhibit A, Site Plan/Landscape Plan; Exhibit B, Proposed
Floor Plan; and Exhibit C, Elevation Plans.
b) All improvements shown on Exhibits A, B, and C, including
buildings and structures, building facings and materials,
landscaping, curbing, paving and parking lot striping, shall
be completed by June 1, 1977.
