HomeMy WebLinkAbout5515 - ADMIN Resolution - City Council - 1976/05/03MAY 3, 1976 8C RESOLUTION NO. 55, 15 A RESOLUTION GRANTING VARIANCE IN SIDE YARD REQUIREMENTS FROM SECTION 6:074.5 OF THE ZONING ORDINANCE PERMITTING SIDEYARDS OF 4.5 FEET AND 7.5 FEET IN THE R-2 SINGLE FAMILY DISTRICT BE IT RESOLVED BY the City Council of St. Louis Park, Minnesota: Findings 1. Jeanine Rochat has applied for a variance from Section 6:074.5 of the Zoning Ordinance to permit side yards of 4.5 feet and 7.5 feet instead of the required 9 feet and 11 feet for a two-story home in the R-2 Single Family District at the following location, to -wit: Lot 17, Block 3, Thorpe Brothers University Club Addition, commonly known as 1664 Blackstone Avenue. 2. The Board of Appeals has reviewed the application for a variance '(Case No. 75 -89 -VAR), and its action has been reported to the'Council. 3. The Council has considered the effect of the proposed variance upon the health, safety, and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area and the effect of the proposed variance upon the Comprehensive Plan. 4. Because of conditions on the subject property and on the surrounding property, it is possible to use the subject property in such a way that the proposed variance will not impair an adequate supply of light and air to adjacent property, unreasonably increase the congestion in the public streets, increase the danger of fire, endanger the public safety, unreasonably diminish or impair health, safety, comfort, morals, or in any other respect be contrary to the intent of the ordinance and the Comprehensive Plan. 5. The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property and do not apply generally to other land or structures in the District in which such land is located. • 6. The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant. It will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable hardship or difficulty. 7. The following conditions and safeguards are necessary in order to ensure and will, in fact, ensure that there will be no unreasonably adverse consequences to the granting of the variance: BUILDING STRUCTURE (1) Install double 2x8 -foot headers at mid span of rafters in three bedrooms of the new addition. (2) Remove flat 2x4 -foot header over all windows and door openings in addition and replace with properly sized double headers complying with the minimum standard of the State Building Code. (3) Remove existing non-openable windows in bedrooms and replace with proper openable-type windows complying with the re- quirements for habitable rooms as to natural light, ventilation and emergency exits. (4) Remove "railroad tie" footing at north wall of new addition and replace with a properly sized concrete footing to a depth of not less than 42" below grade. (5) Provide handrail for the stairway leading to the second story addition. PLUMBING (6) The second floor bathroom fixtures are illegally connected to the vent stack of the first floor fixtures. A new waste stack must be connected below the lowest fixture on the first floor to allow proper waste and venting of the entire system. (7) Plastic piping for fixtures on the second floor have a mixture of A.B.S. and P.V.C. pipe. The plumbing standards do not allow mixture of the two types; therefore all A.B.S. or P.V.C. must be used. (8) Kitchen sink on first floor must be properly vented. (9) Mechanical ventilation for second floor bathroom must be vented directly to outside air. (10) Remove flexible connection to kitchen stove and replace with rigid pipe or copper tubing with flaired fittings. (11) Install legal anti -siphon ballcock in flush tank on first floor bathroom. (12) Waterproof the ceiling over tub and shower in existing first floor bathroom. -2- r 1 ATTR rI'• r•-• - • p^1 711,-` ELECTRICAL (13) All wiring systems in new addition must be exposed for visual inspection. (14) The main 60 amp. service must be corrected and checked for adequacy. (15) Main service mast and disconnect must be properly installed. (16) Wiring to the range hood in kitchen must be corrected. (17) Wiring in closet on first floor bedroom must be corrected. Conclusion The application for a variance for the purpose designated is granted, based upon the findings set forth above and subject to the conditions set forth in paragraph 7 of these findings.
