HomeMy WebLinkAbout5506 - ADMIN Resolution - City Council - 1976/04/19APRIL 19, 1976 RESOLUTION NO. 5506 A RESOLUTION GRANTING PERMIT UNDER SECTION 6:102.5 OF THE ZONING ORDINANCE TO PERMIT SENIOR CITIZEN HOUSING IN THE R -B RESIDENTIAL BUSINESS DISTRICT AT 7900 WEST 28 STREET Be it resolved by the City Council of the City of St. Louis Park: Findings 1. Texas Terrace Convalescent and Retirement Center has made application to the City Council for a special permit under Section 6:102,5 of the Zoning Ordinance to permit a senior citizen housing addition to an existing nursing home in the R -B Residence Business District at 7900 West 28 Street having the following legal description: The west 447.1 feet of the north one-half of the southwest quarter of Section 8, Township 117, Range 21, Hennepin County, Minnesota, lying southerly of the Hutchinson Branch, Great Northern Railway right of way. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No, 76 -14 -SP) and the effect of the proposed use on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan. 3. The Council has determined that the proposed use will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed use is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit senior citizen housing at the location described is granted based on the findings set forth above and subject to the following conditions: • 1. The site shall be devleoped, used and maintained in accordance with Exhibit A, Site Plan/Floor Plan; Exhibit B, Landscape Plan; Exhibit C, Typical Unit Plan; and Exhibit D, Elevation Plan. 2. That the applicant enter into an appropriate covenant running with the land limiting that portion of the site plan identified as senior citizen housing to be used for senior citizen housing until June 15, 1997, unless proof that such housing is funded by a governmental agency with a mortgage of 20 years or more, and said covenant shall be filed with the City prior to the issuance of a building permit. 3. That all site improvements including structures, parking access and paving, landscaping, open space amenities and other facilities as shown on the identified exhibits be completed by June 15, 1977.
