HomeMy WebLinkAbout5503 - ADMIN Resolution - City Council - 1976/04/19RESOLUTION NO. 553 RESOLUTION GIVING APPROVAL FOR FINAL PLAT OF LOU PARK ADDITION APRIL 19, 1976 WHEREAS, Daniel F. Otten, Louise A. Otten and Vicent E. Johnson, the owners and subdividers of the land proposed to be platted as Lou Park Addition, have submitted their application for approval of final plat of said subdivision in the manner re- quired for platting of land under the St. Louis Park Ordinance Code, and all proceedings have been duly had thereunder, and WHEREAS, said plat is in all respects consistent with the City Plan and the regulations and requirements of the Laws of the State of Minnesota and the ordinances of the City of St. Louis Park, and WHEREAS, said plat is situate upon the following described lands in Hennepin County, Minnesota, to -wit: Lou Park Addition, being that part of the East half of the Southeast Quarter of Section 5, Township 117, Range 21 described as follows: Beginning at a point in a line parallel with and 30 feet West of the East line of said Southeast Quarter, distant 233.97 feet North of the Northeast corner of Lot 1, Block 2, "Westwood Park"; thence North 870 38' 30" West, 576.8 feet; thence South 2° 21' 30" West, 202.58 feet; thence South 89° 31' West, 78.02 feet; thence South 45° 56' 15" West, 47.97 feet; thence South 2° 21' 20" West, 76.97 feet to the Northerly line of "Westwood Park 2nd Addition"; thence Westerly along said Northerly line to a point 135 feet East of the Northwest corner of Block 1, in said "Westwood Park 2nd Addition"; thence Northerly parallel with the West line of the East half of said Southeast Quarter a distance of 115 feet; thence Westerly parallel with last said Northerly line 135 feet to an intersection with a line parallel with and 30 feet East of the West line of the East half of said Southwest Quarter; thence Northerly along last said parallel line to a point 435 feet Southerly (measured along last said parallel line) from the Southerly right of way line of United States Highway No. 12 as described in Document 1882158, as recorded in the Office of Register of Deeds, County of Hennepin; thence at a right angle Easterly 500 feet; thence at a right angle Northerly, 455.59 feet to the Southerly line of said United States Highway No. 12; thence Easterly along the Southerly line of said United States Highway No. 12 a distance of 576.27 feet to its intersection with a line drawn South a right angle to the North line of said Southeast Quarter from a point therein distant 215.3 feet West of the Northeast corner of said Southeast Quarter; thence South 212.47 feet along the last described right angle line to its intersection with the Westerly extension of the South line of Rorbach's Addition; thence Easterly 171.61 feet along said South line of Rorbach's Addition and same extended to its intersection with a line parallel with and 30 feet West of the East line of said Southeast Quarter; thence Southerly 648.36 feet along a line parallel with and 30 feet West of the East line of said Southeast Quarter to the point of beginning. Y Page 2 BE IT RESOLVED by the City Council of the City of St. Louis Park: 1. That said plat of Lou Park Addition is hereby approved and accepted by the City as being in accord and conformity with all ordinances,,City plans and regulations of the City of St. Louis Park and the laws of the State of Minnesota subject to the following conditions: (a) All gas, electric, water, sanitary sewer, and telephone utilities be placed underground, (b) All property within the Plat shall be used in accordance with the special permit for a Residential Development Unit and Commercial Development Unit approved by the City Council of St. Louis Park, and provided, however, that this approval is made subject to the approving opinion of the City Attorney as to the title and form and execution of the plat, and execution of a contract for any improvements remaining to be constructed by the subdivider, and bond thereunder, or the certificate of the City Treasurer certifying to a cash deposit in the amount required by the City Council as the estimated cost of improvements to be provided by the subdivider, and if such be the case, the City Engineer's certificate that the remaining improvements required of the subdivider have been completely and properly installed, all as required by the provisions of Section 6:303-C-6 of the St. Louis Park Ordinance Code entitled "Certification by City Clerk." 2. That the City Clerk is hereby directed to file a certified copy of this Resolution in the office of the Register of Deeds and Registrar of Titles for their use as required by MOS.A. 471.29. 3. That the City Clerk is hereby directed to supply a certified copy of this Resolution to the above-named owner and subdivider, who is the applicant herein. 4. That the Mayor and City Manager are hereby authorized to execute all contracts required herein, and the City Clerk is hereby directed to execute the certificate of approval on behalf of the City Council upon the said plat when all of the conditions set forth in paragraph No, 1 above and Section 6:303-C-6 of the Ste Louis Park Ordinance Code have been fulfilled. BE IT FURTHER RESOLVED that such execution of the certificate upon said plat by the City Clerk, as required under Section 6:303-C-6, shall be conclusive showing of proper compliance therewith by'the subdivider and City officials charged with duties above described and shall entitle such plat to be placed of records rthwith without further formality.
