HomeMy WebLinkAbout5493 - ADMIN Resolution - City Council - 1976/03/294- I 9 MARCH 29, 1976 RESOLUTION NO. 5493 A RESOLUTION GRANTING PERMIT UNDER SECTION 6:122.11 OF THE ZONING ORDINANCE TO PERMIT A DRIVE-IN BUSINESS IN THE B-2 DISTRICT UNDER SPECIFIED CONDITIONS Be it resolved by the City Council of St. Louis Park: Findings 1. The Automobile Club of Minneapolis has made application to the City Council for a special permit under Section 6:122.11 of the Zoning Ordi- nance for the purpose of permitting a drive-in business at the northeast corner of West 39 Street and Park Center Boulevard for the legal description as follows: Tract I: That part of the northwest quarter of the north- west quarter of Section 7, Township 28, Range 24, described as follows: Commencing at the northwest corner of the northwest quarter of the northwest quarter of said Section 7, thence running south along the West line of said Section a distance of 443.71 feet, thence east parallel with the north line of said section to the east line of the northwest quarter of the northwest quarter; thence north along the east line of said northwest quarter of northwest quarter to the northeast corner thereof, thence west along the north line of said section to the point of beginning, except the east 924 feet thereof, and except the west 80 feet thereof. Tract II: That part of the south 24 feet of Lot 4, Block 2, Park Center, which lies west of the northerly extension of a line parallel with and distant 924 feet west of the east line of the northwest quarter of the northwest quarter of Section 7, Township 28, North Range 24, west of the 4th Principal Meridian. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 75 -95 -SP) and the effect of the proposed use on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan. 3. The Council has determined that the proposed use will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed use is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a drive-in business at the location described is granted based on the findings set forth above and subject to the following conditions: a. The site shall be developed, used and maintained in accordance with Exhibit A, Site Plan; Exhibit B, Main Floor Plan; Exhibit C, Lower Floor Plan; Exhibit D, Elevation Plans (two pages); and Exhibit E, Landscape Plan. b. Refuse storage dumpsters shall besrreened from view and a solid gate provided. Attest: 411/1 City Clerk Adopted by the City Council March 29, 1976.
