RESOLUTION NO. 5487
A RESOLUTION GRANTING PERMIT UNDER SECTION 6:122.18
OF THE ZONING ORDINANCE FOR AN AUTOMOBILE SERVICE
CENTER FOR PROPERTY LOCATED IN THE B-2 GENERAL BUSINESS
DISTRICT AT 4301 EXCELSIOR BOULEVARD
Be it resolved by the City Council of the City of St. Louis Park:
Findings
1. John Williams and Jerome Essner have made application to the City Council
for a special permit under Section 6:122.18 of the Zoning Ordinance for an
automobile service center located in the B-2 General Business District at 4301
Excelsior Boulevard having the following legal description:
Lots 1-3 and that part of Lot 4 described as follows:
Commencing at the most northerly corner of Lot 4;
thence in a southwesterly direction along said north-
westerly line of Lot 4, 40 feet; thence in a south-
easterly direction parallel with the southwesterly
line of said Lot to the easterly line of said Lot 4;
thence north to the northeasterly corner of said Lot
4; thence in a northwesterly direction along the
northeasterly line of said Lot 4; to the point of
beginning, in Bassford's Addition to St. Louis Park.
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 76 -6 -SP) and the effect of the proposed modification
to the existing use on the health, safety, and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on
values of properties in the surrounding area and the effect of the use on the
Comprehensive Plan.
3. The Council has determined that the proposed use will not be detrimental
to the health, safety, or general welfare of the community nor will it cause serious
traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed modifications to the use are in harmony with the
general purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit an automobile service center at the location described
is granted based on the findings set forth above and subject to the following
conditions:
a. The site shall be developed, used and maintained in accordance
with Exhibit A Site Plan/Landscape Plan; and Exhibit B Elevation
Plan.
b. The free-standing sign shall not exceed 66 square feet sign
surface per side.
c. All work and servicing shall take place totally within the
building.
d. There shall be no outside storage or display of goods, refuse
or trash.
e. No vehicle shall be parked or stored continuously on the site
for more than 60 hours.
f. A concrete curb shall be provided around the periphery of all
paved areas.
g.
All exterior finishing, paving, curbing and landscaping shall
be completed by October 1, 1976.
