RESOLUTION NO. 5466
RESOLUTION ADJUSTING SPECIAL ASSESSMENTS IN
IMPROVEMENT NO. 70-06 FOR STORM SEWER IMPROVE-
MENT
WHEREAS, the City Council has heretofore adopted
Resolution No. 4317 on August 30, 1971 levying an assessment for
a storm sewer improvement in the Shelard Park area.
WHEREAS, said resolution included an assessment against
Plat 49601, Parcel 5000, in the amount of $8,997.68.
WHEREAS, the owner of the above parcel has, pursuant
to Minnesota Statutes, Section 429.081, filed an appeal to the
Hennepin County District Court contesting the amount of special
benefit to the subject property.
WHEREAS, the City Attorney has advised the City Council
that in the light of the issue raised in the assessment appeal,
a reduction in the amount assessed in order to secure the settle-
ment and dismissal of the appeal would be prudent and appropriate;
therefore
BE IT RESOLVED BY THE CITY COUNCIL OF ST. LOUIS PARK:
1. That the City Manager and City Assessor are hereby
directed to reduce the amount of the assessment on the subject
parcel by $2,300.00 to $6,697.68.
2. That in computing the reduced amount, credit is to be
given for the installments of special assessments paid with real
estate taxes due and payable in 1972, 1973, 1974, 1975 and 1976.
In granting credit for amounts previously paid, interest at the
rate of six percent (6%) per annum is to be allowed and added to
the credit attributable to interest payments on installments
based on the amount of the original assessment which is in excess
of $6,697.68, which interest is to be paid by check to the owner
of the parcel, immediately for the years 1972 through 1975, and
for 1976 upon payment of the installment due and payable with 1976
taxes.
3. That the reduced amount, less credit for the amounts
paid in the years 1972, 1973, 1974, 1975 and 1976, is to be spread
over the remaining fifteen years of the special assessment commencing

with installments of the special assessments due and payable with
real estate taxes due and payable in 1977.
