HomeMy WebLinkAbout5453 - ADMIN Resolution - City Council - 1976/01/05JANUARY 5, 1976 9B RESOLUTION NO. 5453 A RESOLUTION AMENDING RESOLUTION 3578 ADOPTED AUGUST 19, 1968, AND RESOLUTION 3499 ADOPTED APRIL 15, 1968, GRANTING PERMIT UNDER SECTION 6:092.10 OF THE ZONING ORDINANCE FOR A 56 - UNIT MULTIPLE FAMILY DWELLING IN THE R-4 MULTIPLE FAMILY DISTRICT Be it resolved by the City of St. Louis Park: Findings 1. Aquila Associates, Ltd., has made application to the City Council for a special permit under Section 6:092.10 of the Zoning Ordinance to permit a 56 -unit apartment building in the R-4 Multiple Family District at 3202 Virginia Avenue South, for the legal description as follows: Lot 3, Block 1, Aquila Park Addition. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 75 -87 -SP) and the effect of the proposed modifica- tion to the existing use on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan. 3. The Council has determined that the proposed use will not be detrimental to the health, safety, or general welfare of the -community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed modification;to the use are in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The amendment to the existing special permit for a Multiple Family Dwelling of 56 units at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed, used, and maintained in accordance with Exhibit A, Site Plan; Exhibit B, Floor Plan (including attachments B-1, B-2, and 8-3); Exhibit C, Landscape Plan; Exhibit D, Fence Elevation; Exhibit E, Sign Plan, except as modified: a. There shall be not less than 44 underground parking spaces and 26 outside parking spaces all of which shall be available to the tenants of the building. 2. Issuance of this special permit does not invalidate or affect the release instrument 3822851 executed March 30, 1970, in connection with possible liability for the canopy located on the easement. 3. All of the modifications and improvements as shown on the exhibits shall be completed by July 1, 1976.
