Home My WebLink About5429 - ADMIN Resolution - City Council - 1975/12/01• • DECEMBER 1, 1975 8G RESOLUTION NO, 5429 AUTHORIZING TAKING OF LAND BY EMINENT DOMAIN FOR PUBLIC RIGHT-OF-WAY AND REMOVAL OF ICC TRACKS # 260, #266, VARIOUS INDUSTRY TRACKS AND MACHINERY UNLOADING RAMP ADJACENT THERETO WHEREAS, the City Council has ordered preparation of a resolution authorizing taking of land by eminent domain and the City Engineer has recommended the acquisition of land for public right-of-way purposes at the locations hereinafter specified, and it appears to the Council that it is necessary that the City acquire such lands, therefore BE IT RESOLVED by the City Council of St. Louis Park: 1. That it is hereby determined that the taking of each of the tracts and parcels of land set forth in paragraph 3 hereof is necessary for the public good in order that said tracts and parcels shall be devoted to public right-of-way. 2. That the City shall take by right of eminent domain for public right-of-way purposes the lands described in paragraph 3 hereof, and the City Attorney be hereby authorized and directed to commence proceedings in the District Court of Hennepin County for appointment of Commissioners to determine the damages, if any, sustained by the respective owners of the parcels affected by such taking, as authorized by law, and 3. That the lands above referred to are more particularly described as per Exhibit A attached. Adopted by the City Council December 1, 1975.
