RESOLUTION NO, 5429
AUTHORIZING TAKING OF LAND BY EMINENT
DOMAIN FOR PUBLIC RIGHT-OF-WAY AND
REMOVAL OF ICC TRACKS # 260, #266,
VARIOUS INDUSTRY TRACKS AND MACHINERY
UNLOADING RAMP ADJACENT THERETO
WHEREAS, the City Council has ordered preparation of a resolution
authorizing taking of land by eminent domain and the City Engineer
has recommended the acquisition of land for public right-of-way purposes
at the locations hereinafter specified, and it appears to the Council
that it is necessary that the City acquire such lands, therefore
BE IT RESOLVED by the City Council of St. Louis Park:
1. That it is hereby determined that the taking of each of the
tracts and parcels of land set forth in paragraph 3 hereof is necessary
for the public good in order that said tracts and parcels shall be devoted
to public right-of-way.
2. That the City shall take by right of eminent domain for public
right-of-way purposes the lands described in paragraph 3 hereof, and the
City Attorney be hereby authorized and directed to commence proceedings
in the District Court of Hennepin County for appointment of Commissioners
to determine the damages, if any, sustained by the respective owners of
the parcels affected by such taking, as authorized by law, and
3. That the lands above referred to are more particularly described
as per Exhibit A attached.

PARCEL 1
An easement for public right-of-way purposes over, under, and
across the following described property.
All that part of Lots 6, 7, and 8, Block 324,
"Rearrangement of St. Louis Park", according to
the recorded plat thereof, and of vacated First
Street Northwest, which accrued to said Lot 8
by the reason of the vacation thereof, lying
easterly of a line drawn between the most north-
erly corner of said Lot 6 and a point in the
centerline of said vacated First Street North-
west, 200.00 feet southwesterly of the point of
intersection of said centerline with the south-
easterly extension of the northeasterly line of
said Lot 8, as measured along said centerline.
Containing 19,190 square feet or 0.4405 acres,
more or less.
Together with a slope easement over, under and across the
following described property.
All that part of the following described tract: Lots 5, 6, 7
and 8, Block 324, "Rearrangement of St. Louis Park", according
to the recorded plat thereof, and that part of vacated First
Street Northwest, which accrued to said Lot 8 by reason of the
vacation thereof, described as follows.
Lying westerly of Line "A" and easterly of Line "B",
said Line "A" and Line "B" are described as follows:
Line "A" is a line drawn between the most northerly
corner of said Lot 6 and a point on the centerline
of said vacated First Street Northwest, 200.00 feet
southwesterly of the point of intersection of said
centerline with the southeasterly extension of the
northeasterly line of said Lot 8, as measured along
said centerline.
Line "B" is a line drawn between a point on the
northerly line of said Lot 5, distant 15.00 feet
northwesterly from the most easterly corner of
said Lot 5 as measured along said northerly line
and a point on the centerline of said vacated
First Street Northwest, 235.00 feet southwest of
the point of intersection of said centerline with
the southeasterly extension of the northeasterly
line of said Lot 8, as measured along said center-
line.

Containing 5150 square feet or 0.1182 acres, more
or less.
Together with a temporary construction easement over, under
and across the following described as follows.
All that part of the following described tract: Lot 8, Block
324, "Rearrangement of St. Louis Park", according to the re-
corded plat thereof, and that part of vacated First Street
Northwest which accrued to said Lot 8 by reason of the vaca-
tion thereof, described as follows.
Being westerly of Line "B" described herein, and
easterly of a line 20 feet westerly, as measured
at right angles, from Line "B".
Containing 2100 square feet or 0.048 acres, more
or less.

An easement for public right-of-way purposes over, under, and
across the following described property.
That part of the following described tract:
All of Lot 19 in Block 324 in the "Rearrangement of St.
Louis Park"; together with that part of Lot 18 in said
Block 324 lying Southwesterly of a line drawn radially
to the Northwesterly line thereof at a point thereon
distant 330 feet Northeasterly from the intersection of
said Northwesterly line, and its Southwesterly extension,
with the center line of Hurst Street; together with that
part of the Southeast Quarter of the Southwest Quarter of
Section 17, Township 117 North Range 21 West of the Fifth
Principal Meridian, lying Southerly of the South line, ex-
tended Easterly, of Broadway (Walker Street); lying North-
easterly of the center line, extended, of Hurst Street;
lying North westerly of the Southwesterly extension of
the Southwesterly line of said Lot 18; and lying South-
westerly and Westerly of the Southwesterly and Westerly
lines of said Lots 18 and 19.
Commencing at the point of intersection of the centerlines
of Pennsylvania Avenue and Walker Street in the Rearrangement
of St. Louis Park according to the recorded plat thereof; thence
North 88 degrees 52 minutes 05 secondsEast, assumed basis for
bearings, along the centerline of said lker Street, 592.87
feet, to an intersection with the northwesterly extension of
the centerline of Hurst Street (vacated) in the Rearrangement
of St. Louis Park; thence South 57 degrees 52 minutes 27 seconds
East, along said centerline of Hurst Street, 285.43 feet to the
point of beginning of the line herein described; thence north-
easterly 220 feet along a curve having a radius of 276.56 feet
the center of circle of said curve bears South 89 degrees
35 minutes 54 seconds East from the point of beginning and
there terminating.

That part of Lot 6, Block 323, "Rearrangement of St.
Louis Park", described as commencing at the Southeast
corner of Lot 10; thence Southerly along the Westerly
line of Lot 6 to the South line thereof; thence East
on the South line of Lot 6 to a point 40 feet West
from the Southeast corner of said Lot 6; thence Northerly
parallel with the Westerly line of Lot 6 to the inter-
section with the Southerly line of Lot 10 produced;
thence West to the point of beginning except State
Highway, also excepting all that part of Lot 6 lying
South of State Highway No. 7, according to the re-
corded plat thereof;
lying northwesterly of State Highway No. 7 and southeasterly
of a line distant 22.00 feet northwesterly of measured at
right angles to, the following described line.
Commencing at the point of intersection of the center-
