RESOLUTION NO. 5424
A RESOLUTION GRANTING PERMIT UNDER SECTION 6:092.10 OF
THE ZONING ORDINANCE FOR PURPOSES OF CONSTRUCTING A
108 -UNIT MULTIPLE FAMILY DWELLING FOR PROPERTY LOCATED
IN THE R-4 MULTIPLE FAMILY DISTRICT AT 1351 HAMPSHIRE
AVENUE SOUTH
Be it resolved by the City Council of the City of St. Louis Park:
Findings
1. Daniel Otten has made application to the City Council for a special
permit under Section 6:092.10 of the Zoning Ordinance for the purpose of
permitting a 108 -unit multiple family dwelling at 1351 Hampshire Avenue,
or the legal description which follows:
That part of East 1/2 of Southeast 1/4 of Section 5,
Township 117, Range 21, described as follows: Beginning
at a point in a line parallel with and 30 feet East of
West line of said East 1/2 of Southeast 1/4, said point
being distant 435 feet South, measured along said parallel
line, from the Southerly right of way line of United
States Highway No. 12 as described in Document No. 1882158
as recorded in the Office of the Register of Deeds, County
of Hennepin; thence South along said parallel line 428.90
feet; thence at a right angle East 620 feet; thence at a
right angle North 428.90 feet; thence at a right angle
West 620 feet to the point of beginning.
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 75 -51 -SP) and the effect of the proposed modifica-
tions to the existing use on the health, safety, and welfare of the occupants
of the surrounding lands, existing and anticipated traffic conditions, the
effect on values of properties in the surrounding area and the effect of the use
on the Comprehensive Plan.
3. The Council has determined that the modification to the existing use
to construct the proposed 108 -unit multiple family residence will not be
detrimental to the health, safety, or general welfare of the community nor will
it cause serious traffic congestion nor hazards, nor will it seriously depreciate
surrounding property values, and the proposed modifications to the use are in
harmony with the general purpose and intent of the Zoning Ordinance and the
Comprehensive Plan.

Conclusion
The special permit to permit a 108 -unit multiple family dwelling at the location
described above is granted based on the findings set forth above and subject
to the following conditions:
1. The site shall be developed, used and maintained in accordance
with Exhibit "A," Site Plan, Exhibit "B," Landscape Plan as
modified August 14, 1975, Exhibit "C," Grading Plan, Exhibit "D,"
Building Elevation Plan, and Exhibit "E," Floor Plan.
2. The building shall be provided throughout with an automatic
fire extinguishing system.
3. All construction, paving, striping, landscaping, lighting,
and recreational facilities shall be completed by October 1,
1976.
