A RESOLUTION AMENDING RESOLUTION NO. 5324, ADOPTED JUNE 30,
1975, GRANTING PERMIT UNDER SECTION 6:122.17 OF THE
ZONING ORDINANCE FOR MODIFICATION AND EXPANSION OF A CLASS
I RESTAURANT FOR PROPERTY LOCATED IN THE B-2 GENERAL
BUSINESS DISTRICT AT 5600 WAYZATA BOULEVARD
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Eddie Webster's, Inc., has made application to the City Council for an
amendment to an approved special permit under Section 6:122.17 of the Zoning
Ordinance to permit modification and expansion of a Class I Restaurant located at
5600 Wayzata Boulevard for the legal description as follows:
That part of Government Lot 5, Section 4, Township 117,
Range 21 lying North of U.S. Highway 12 and South of Wayzata
Boulevard subject to lot easement over the West 33 feet thereof
and subject to highway easement of the East 50 feet of the West
436 feet thereof
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 75 -74 -SP) and the effect of the proposed modifica-
tions to the existing use on the health, safety, and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values
of properties in the surrounding area and the effect of the use on the Comprehensive
Plan.
3. The Council has determined that the modification to the existing use to
permit expansion and modification of the existing facility will not be detrimental
to the health, safety, or general welfare of the community nor will it cause
serious traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed modifications to the use are in harmony with the
general purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The amendment to the special permit to permit modification and expansion of a Class I
Restaurant at the location described is granted based on the findings set forth
above and subject to the following conditions:
a) That the site be developed, used and maintained in accordance
with the previously approved exhibits as contained in
Resolution No. 5324 and said Exhibits shall remain in effect
except as modified below:
1. That the site be developed, used, and maintained in
accordance with Exhibit "G," Revised Elevation Plan,
to accommodate the adjustment in the roof structure at
the northwest corner of the building.
2. That the most westerly parking lot located between
Yosemite Avenue and Zarthan Avenue and south of
Superior Boulevard be permitted to have asphalt
curbing.
b) That on or before June 1, 1980, the applicant shall submit a
plan for concrete curbing of the parking lot as described
above.
c) That all work and improvements as contained in this permit and
as adopted in Resolution No. 5324 be completed by June 1, 1976.
