NOVEMBER 3, 1975 9C 414(1 A RESOLUTION GRANTING PERMIT UNDER SECTION 6:122.17 OF THE ZONING ORDINANCE TO PERMIT A CLASS IV RESTAURANT, AND AMENDING RESOLU- TION NO. 5002 AND RESOLUTION NO. 4427 GRANTING PERMIT UNDER SECTION 6:122.11 OF THE ZONING ORDINANCE FOR PROPERTY LOCATED IN THE B-2 GENERAL BUSINESS DISTRICT AT 6320 WEST LAKE STREET BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. McDonald's Corporation has made application to the City Council for a special permit under Section 6:122.17 of the Zoning Ordinance for the purpose of permitting a Class IV Restaurant at 6320 West Lake Street for the legal description as follows: That part of Lots 8 and 9, Block 5, St. Louis Park, north addition and that part of Lots 25, 26, 27, 28, 29, 30, 31 and 32, Block 189 Rearrangement of St. Louis Park together with all that part of adjoining vacated streets, avenues and alleys described as follows: Beginning at a point in the southeasterly line of said Lot 28, distance 42.33 feet northeasterly of the most southerly corner of said Lot 28; thence northeasterly to a point in the north line of said Lot 25, distance 4.3 feet east of the north corner of said Lot 25; thence west along the north line of said Lot 25 and same extended 10.3 feet to the center line of vacated alley; thence south along center line of said vacated alley 47.65 feet more or less to its intersection with the north line of Lot 3, Block 5, St. Louis Park north addition extended east; thence, west along said extended line to the northeast corner of said Lot 9; thence southwest along a straight line to the southwest corner of said Lot 32, Block 189; thence continuing southeast along the extension of last described line to the intersection with the west line of Lots 8 and 9, Block 5, St. Louis Park north addition extended south; thence south along said west line of said Lot;8 and 9 extended 87.0 feet; thence on an angle to the left of 40 degrees, 9 minutes, 69.1 se- confs to its intersection with the southeasterly line of Block 189 Rearrangement of St. Louis Park extended southwesterly; thence northeasterly along said southeasterly line of said Block 189, and its extension to the point of beginning, and That part of Lots 4, 5 and 6, Block 5, Maple Park Addition to St. Louis Park North and that part of adjoining vacated alley described as follows: Beginning at the Northeast corner of said Lot 4; thence South along the East line of said Lots 4, 5 and 6 • to the Southeast corner of said Lot 6; thence West abng the South line of said Lot 6 and same extended to the center line of vacated alley in said Block 5; thence Northeasterly to a point in the North line of said Lot 4, distant 3.11 feet West of the point of beginning; thence East 3.11 feet to point of beginning, according to the plat thereof on file or of record in the office of the Register of Deeds in and for said county and state; and That part of Lots 8, 9 and 10, Block 5, St. Louis Park North and that part of Lot 32, Block 189, Rearrangement of St. Louis Park and that part of adjoining vacated alley and street described as follows: Beginning at the intersection of the Westerly extension of the South line of Lot 6, Block 5, Maple Park Addition to St. Louis Park North with the center line of the vacated alley in said Block and Addition; thence South along said center line to an intersection with the Easterly extension of the North line of said Lot 9; thence west along last said extended line to the Northeast corner of said Lot 9; thence Southwesterly along a straight line to the Southwest corner of said Lot 32; thence continuing Southwesterly along an extension of said straight line to an intersection with the Southerly extension of the West line of said Lot 8; thence North along the West line of said Lot 8 and the same extended a distance of 26.97 feet to an intersection with the Southwesterly extension of a line drawn from the point of beginning to a point in the North line of Lot 4, Block 5, said Maple Park Addition, distant 3.11 feet West of the Northeast corner of said Lot 4; thence Northeasterly 190.91 feet along said line so drawn to the point of beginning, according to the plat thereof on file or of record in the office of the Register of Deeds in and for said county and state, and That part of Lots 4, 5, 6 and 7, Maple Park Addition to St. Louis Park North and that part of Lots 8, 9 and 10, Block 5, St. Louis Park North and that part of Lot 32, Block 189, Rearrangement of St. Louis Park and that part of adjoining vacated alley and street described as follows: Beginning at a point in the North line of said Lot 4, distant 20.95 feet West, of the Northeast corner of said Lot 4; thence East along said North line 17.84 feet; thence Southwesterly 192.88 feet to the point of intersection of Westerly extension of said Lot 6 with the center line of vacated alley in said Block; thence continuing Southwesterly 190.91 feet along an extension of last described course to the East line of Dakota Avenue; thence North along said East line 17.73 feet; thence Northeasterly 359.24 feet to the point of beginning, according to the plat thereof on file or of record in the office of the Register of Deeds in and for said county and state; Except for the northeasterly 104 feet of the following described Tract: Commencing at the northeast corner of Lot 4, Block 5, Maple Park Addition to St. Louis Park North; thence westerly along the north line of Lot 4 on an assumed bearing of South 89023'38" west for a distance of 3.11 feet which is the actual point of beginning; thence continuing along said north line a distance of 17.84 feet; thence in a southwesterly direction along a line on an assumed bearing of South 43°12'43" West for a distance of 359.24 feet to a point in the west line of Lot 8, Block 5, St. Louis Park North; thence south 17.73 feet; thence northwesterly on an assumed bearing of North 43°12'43" East for a distance of 383.29 feet to the point of beginning and there terminating and -2- • • Jr Except for the following described tract: Commencing at the southeast corner of Lot 6, Block 5, Maple Park Addition to St. Louis Park North, Section 16, Township 117, Range 21, Hennepin County; thence northerly along the east line of Lot 6 on an assumed bearing of North 0048'37" west for a distance of 139.11 feet to the northeast corner of Lot 4; thence westerly along the north line of Lot 4 on an assumed bearing of South 89°23'38" west for a distance of 3.11 feet; thence in a southwesterly direction along a line on an assumed bearing of South 43°12'45" east for a distance of 104.0 feet; thence in a southeasterly direction along a line to the point of beginning and there terminating. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 75 -71 -SP) and the effect of the proposed modifi- cations to the existing use on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan. 3. The Council has determined that the modification to the existing use to permit expansion and modification of the existing facility will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate sur- rounding property values, and the proposed modifications to the use are in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a Class IV Restaurant at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed, used and maintained in accordance with the previously approved special permit and exhibits and conditions thereto, except as modified by Exhibit "L," Revised Site Plan; Exhibit "M," Revised Landscape Plan; Exhibit "N," Footing and Foundation Plan; Exhibit "0," Floor Plan; Exhibit "P," Roof Framing Plan; Exhibit "Q," Revised Elevation Plan; Exhibit "R," Seating Plan; and Exhibit "S," Seating and Partition Elevation. 2. The pedestrian access points at the northeasterly and south- westerly sides of the building shall extend at least 16 feet into the parking lot area. 3. Eating outside the building on the premises is prohibited in accordance with the provisions of the Zoning Ordinance. 4. That all improvements including building, pedestrian facilities and landscaping be completed by June 1, 1976. -3- 5. Due to sight distance and traffic conditions, the access point on Dakota Avenue be signed and used for ingress only, and the most southwesterly access point on Lake Street be signed and used for exit only.
