RESOLUTION NQ. 5396
A RESOLUTION GRANTING VARIANCE FROM SECTION 6:172.5,
SUBD. 1, OF THE ZONING ORDINANCE TO PERMIT A LOADING
DOCK AND BERTH IN THE FRONT YARD SETBACK FOR AN
EXISTING BUIL,MG IN THE I-1 INDUSTRIAL DISTRICT
BE IT RESOLVED BY the City Council of St, Loyis Park, Minnesota:
Findings
1. Pic -A -Pop, Minn., Inc., has applied for a variance from Section 6:172.5,
Subd. 1, of the Zoning Ordinance to permit a loading berth and dock in the front
yard setback for a building located in the I.1 District at the following location,
to -wit:
Lots A, B, C, and D, Registered Land Survey No. 297 and
the West 24 feet of the North 1/2 of Lot 11 and the East 22
feet of Lot 10 and the West 29 feet of the South 1/2 of
Lot 11, Block 32,,St. Louis Park Center, commonly known as
3550 Brunswick Avenue South,
2. The Board of Appeals has reviewed the application for a variance (Case No.
75 -67 -VAR) and has recommended to the City Council that the application be granted
with cpnditions1
3. The Council has considered the effect of the proposed variance upon the
health, safety, and welfare of the community, existing and anticipated traffic condi-
tions, light and air, danger of fire, risk to the public safety, and the effect on
values of property in the surrounding area and the effect of the proposed variance
upon the Comprehensive Plan.
4. Becauseof conditions on the subject property and on the surrounding property,
it is possible to use the subject property in such a way that the proposed variance
will not impair an adequate supply of light and air to adjacent property, unreasonably
increase the congestion in the public streets, increase the danger of fire, endanger
the public safety, unreasonably diminish or impair health, safety, comfort, morals, or
in any other respect be contrary to the intent of the ordinance and the Comprehensive
Plan.
5. The special conditions applying to the structure or land in question are
peculiar to such property or immediately adjoining property, and do not apply generally
to other land or structure in the district in which such land is located.
6. The granting of the variance is necessary for the preservation and
enjoyment of a substantial' property right of the applicant. It will not merely serve
as a convenience to the applicant, but is necessary to alleviate demonstrable hardship
or difficult,.
7. The following conditions and safeguards are necessary in order to
ensure and will in fact ensure that there will be no unreasonably adverse conse-
quences to the granting of the variance:
a. The loading dock enclosed within the building at the
northwest corner shall be designed so that a truck may
be parked at thedock and the overhead door completely
closed.
b. The outside dock at the north side of the building shall
not be utilized for the unloading of any truck or trailer
for more than eight (8) consecutive hours nor shall trucks
or trailers be parked for warehousing purposes.
c. The, front yard and right-of-way areas on the north
side of the building, except for the driveways to the
loading docks, shall be landscaped with live landscaping.
d. The site improvements as described shall be completed
by May 1, 1976.
Conclusion
DThe application for a variance for the purpose designated is granted, based upon
the findings set forth above and subject to the conditions set forth in paragraph 7
of these findings.
