HomeMy WebLinkAbout5395 - ADMIN Resolution - City Council - 1975/10/27• OCTOBER 27, 1975 RESOLUTION NO- 5395 A RESOLUTION AMENDING RESOLUTION NO 5150 AND RESOLUTION NO. 4850 GRANTING PERMIT UNDER SECTION 6:121 2 and 6:111.3(1) OF THE ZONING ORDINANCE TO EXPAND AN EXISTING MOTOR FUEL STATION AND GROCERY STORE FOR PROPERTY LOCATED IN THE B-2 GENERAL BUSINESS DISTRICT AT 5430 MINNETONKA BOULEVARD Be it resolved by the City Council of the City of St. Louis Park: Findings 1. Roger Ilstrup has made application to the City Council for a special permit under Sections 6:121.2 and 6:111.3(1) of the Zoning Ordinance for the purpose of expanding an existing motor fuel station/grocery store located at 5430 Minnetonka Boulevard and having the following legal description: The south 140 feet of Lots 15 and 16, Auditor's Subdivision No. 351 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No, 75 -66 -SP) and the effect of the proposed modifi- cations to the existing use on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the comprehensive plan, 3. The Council has determined that the modification to the existing use to permit expansion and modification of the existing facility will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed modifications to the use are in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit amending a special permit for expansion of an existing motor fuel station/grocery store at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used, and maintained in accordance with Exhibit "A" except as modified by Exhibit "C," Site Plan/ Landscape Plan; Exhibits "D," "E," "F," Elevation Plans/Sign Plans. 2. That the lilac hedge be continued along the northerly edge of the property. 3. That no signs be added to the site nor shall there be any signs attached to the exterior of the windows nor shall there be any signs on the pump islands, in the landscaped areas or other portions of the site except as shown on the approved exhibits, • 4. There shall be no additional lighting on the site except as shown on the plans, and all such lighting is to be directed away from the public right of way and private property. 5. All trash shall be stored within the building in appropriately designated areas. 6. There shall be no outside storage or sales of goods/materials except as allowed under the provisions of Section 6:111.3(1) of the Zoning Ordinance. 7. That all improvements including buildings, exterior materials, landscaping, and required parking, as shown on the exhibits shall be completed by June 30, 1976, and shall be maintained in a satisfactory condition thereafter.
