HomeMy WebLinkAbout5393 - ADMIN Resolution - City Council - 1975/10/20lip RESOLUTION NO. 5393 A RESOLUTION AUTHORIZING THE TAKING OF LAND BY EMINENT DOMAIN FOR PARK, STREET, PEDESTRIAN WAY AND UTILITY PURPOSES BE IT RESOLVED by the City Council of St. Louis Park: 1. 'Certain parcels along Minnehaha Creek have been designated for park, street, pedestrian way, and utility purposes at the location hereinafter specified, and it appears to the Council that it is necessary that the City acquire such lands. 2. The taking of each of the tracts and parcels of land set forth in paragraph 4 is necessary for the public good in order that said tracts and parcels shall be devoted to the public purposes specified. 3. The City shall take by right of eminent domain for park, street, pedestrian way and utility purposes the lands described in paragraph 4 hereof, and the City Attorney be hereby authorized and directed to commence proceedings in the District Court of Hennepin County for appointment of Commissioners to determine the damages, if any, sustained by the respective owners of the parcels affected by such taking, as authorized by law, and 4. That the lands above referred to are more particularly described in Exhibits A, B, C, D, E, F, G, and H as follows: Exhibit A A permanent easement for a public pedestrian way and utility purposes (including installation and maintenance of traffic control signals) in and over the following describeiproperty: All that part of the Southwest 1/4 of the Southeast 1/4 of Section 18, Township 117, Range 21, Hennepin County, Minnesota, lying Easterly and Northeasterly of the following described parcel, hereinafter described as Tract I: TRACT l All that part of the Southwest 1/4 of the Southeast 1/4 of Section 18, Township 117, Range 21, Hennepin County, Minnesota, lying Southerly of West 36th Street, as described in Document Numbers 2871012 and 3679938 and lying Northeasterly and Easterly of Aquila Avenue as described in Document Number 2964984; which also lies Westerly and Southwesterly of a line idrawn parallel with and 30 feet Easterly and Northeasterly of the following described line: Commencing at the point of intersection of the centerline of Aquila AvRnue and the Northerly right-of-way line of West 36th Street; thence S 4v-14'-48" E a distance of 28.89 feet to beginning of a tangential curve to the left and a radius of 881.47 feet; central angle of 43v-40'; thence Southeasterly along said curve a distance of • 671.79 feet; thence S 47°-54'-48" E tangent to said curve along a line hereinafter referred to as line 1 a distance of 64.38 feet t8 a point hereinafter referred to as Point "A"; thence continuing S 47"-54'-48" E a distance of 200 feet and there terminating; except that part of the above described tract of land which lies southwesterly of the following described line: Commencing at the above described Point "A"; thence Northeasterly at right angles to the above described line 1 to an intersection with the Northeasterly line of Aquila Avenue as described in Document Number 2964984; thence Southeasterly to a point which is 54 feet Northeasterly from the above described.point of i:rmination as measured at right angles to the above described line 1 and there terminating, and lying Westerly and Southwesterly of a line commencing on the Southern Right -of -Way line of W. 36th Street and 45' Easterly of line 1; thence a distance of 514.32' in a Southerly direction 45' Easterly of and parallel to line 1; thence at right angles 9' Southwesterly to a point 36' Easterly of line 1; thence in a Southerly direction paralleling line 1, and ending along the Northeast Line of Tract 1 above described. Exhibit B An easement for street and utility purposes in and over the following described Tracts I and II: Tract I. All that part of the Southwest 1/4 of the Southeast 1/4 of Section 18, Township 117, Range 21, Hennepin County, Minnesota, lying Southerly of West 36th Street, as described in Document Numbers 2871012 and 3679988 and lying Northeasterly and Easterly of Aquila Avenue as described in Document Number 2964984; which also lies Westerly and Southwesterly of a line drawn parallel with and 30 feet Easterly and Northeasterly of the following described line: Commencing at the point of intersection of the centerline of Aquila Avenu8 and the Northerly right-of-way line of West 36th Street; thence\S 4"-14'-48" E a distance of 28.89 feet to the beginning of a tangenAial curve to the left and a radius of 881.47 feet; central angle of 43"-40'; hence Southeasterly along said curve a distance of 671.79 feet; thence S 47"-54'-48" E tangent to said curve along a line hereinafter referred to as Line 1 a distance of 64.38 feet to a point hereinafter referred to as Point "A"; thence continuing S 47°-54'-48" E a distance of 200 feet and there terminating; except that part of the above described tract of land which lies Southwesterly of the following described line: Commencing at the above described Point "A"; thence Northeasterly at right angles to the above described line 1 to an intersection with the Northeasterly line of Aquila Avenue as described in Document Number 2964984; thence Southeasterly to a point which is 54 feet Northeasterly from the above described point of termination as measured at right angles to the above described Line 1 and there terminating, and -2- 41111 Tract II. Commencing at a point 30 feet Southerly along the 1/4 line from the Northwest corner of the Southwest 1/4 of the Southeast 1/4 of Section 18, Township 117, Range 21, Hennepin County, Minnesota, which will be called the point of beginning; thence 20 feet Southerly along the 1/4 line; thence 120.00 feet Easterly along a line paralleling the north nine of the Southwest 1/4 of the Southeast 1/4 to a point of curvature of a 31'53'24" curve to the right to its intersection with the western Right-of-Way line of Aquila Avenue; thence northerly along the right-of-way line to a point 30 feet south of the north line of the southwest 1/4 of the southeast 1/4; thence westerly along the southern right-of-way line of West 36th Street to the point of beginning. For the purpose of this description said Northerly right-of-way line of West 36th Street is considered to be a line bearing S 880-45' E. Exhibit C An easement for permanent open-space purposes, and open-space use or uses of said land shall be for park and recreational purposes, conservation of land and other natural resources, or historic or scenic purposes, in over and across: • • All that portion of Tract Q, Registered Land Survey Number 1058 northwesterly of the following described line: Commencing at the southwest of Said Tract Q; thence northeasterly along the westerly line a distance of 309.97 feet; thence northeasterly along an extension of the westerly line to a point on the northeasterly line of said Tract Q a distance of 410.22 feet northwest of the southeast corner. Exhibit D An easement for park purposes in and over the following described property: Commencing at the southeast corner of southeast one-quarter of northwest one-quarter; thence north 818.8 feet to point of beginning; then west 308 feet; thence south 130 feet; thence southeasterly to a point 250 feet south and 150 feet west of point of beginning; thence east to east line of northwest one-quarter; thence north to point of beginning. All in the north half of Section 20, Township 117, Range 21. Exhibit E An easement for permanent open -space purposes, and open -space use or uses of said land shall be for park and recreational purposes, conservation of land and other natural resources, or historic or scenic purposes, also railroad spur in, over and across that portion of Tract B Registered Land Survey 829 lying southerly of the following described line: -3- • Commencing at a point in the west line of said Tract B Registered Land Survey 829; 60 feet north of the southwest corner; thence easterly and parallel to the southerly line of said Tract B Registered Land Survey 829 to a point in a line 10 feet northerly of and parallel to the center line of existing railroad spur; thence southerly and easterly along said line parallel to center line of railroad spur to a line running southeasterly at right angles from a point in the northwesterly line thereof distant 580 feet southwesterly from the most northerly corner of said Tract B Registered Land Survey 829 and there terminating. Exhibit F An easement for park purposes in and over the following described property: Commencing 200 feet south of northwest corner of southwest one-quarter of northwest one-quarter, Section 20, Township 117, Range 21; thence east 200 feet; thence south 191 feet to northwesterly line of Minneapolis and St. Louis Railway right-of-way; thence southwesterly along same 221-4/10 feet to west line of southwest one-quarter of northwest one- quarter; thence north 285-7/10 feet to beginning. Exhibit G An easement for park purposes in and over the following described property: Commencing at the northwest corner of south one-half of southeast one-quarter Section 18, Township 117, Range 21, then south 87.45 feet; thence deflecting to the left 71 0 minutes 30 secondidistant 325.2 feet; thence north parallel to the west line of southeast one- quarter; to the north line of the south one-half of the southeast one- quarter; thence west along the north line of the south one-half of southeast one-quarter to point of beginning less the following, commencing at a point 30 feet southerly along the 1/4 line from the northwest corner of the southwest one-quarter of the southeast one- quarter of Section 18, Township 117, Range 21, Hennepin County Minnesota, which will be called the point of beginning; thence 20 feet southerly along the one-quarter line; thence 120.00 feet easterly along a line paralleling the north line of the southwest one-quarter of the southeast one-quarter to a point of curvature of a 310 53'24" curve to the right to its intersection with the western right-of-way line of Aquila Avenue; thence northerly along the right-of-way line to a point 30 feet south of the north line of the southwest one-quarter of the southeast one- quarter; thence westerly along the southern right-of-way line of West 36th Street to the point of beginning. -4- • • • Exhibit H An easement for park purposes in and over the following described property: Tract K in Registered Land Survey 1058 in Section 18, Township 117, Range 21, St. Louis.Park, County of Hennepin, State of Minnesota.
