RESOLUTION NO. 5325
RESOLUTION AUTHORIZING TAKING OF LAND
BY EMINENT DOMAIN FOR STORM SEWER
PURPOSES
WHEREAS, the City Council on December 17, 1973 adopted
Resolution No. 4977, "Resolution Ordering Improvement, Ordering
Preparation of Plans, and Authorizing Advertisement for Bids,
Improvement No. 72-43", and
WHEREAS, the Project 72-43 provides for a 36" storm sewer
undercrossing of the Chicago and Northwestern Railroad tracks
near Taft Avenue in order to provide a discharge from the
drainage area, therefore
BE IT RESOLVED by the City Council of St. Louis Park:
1. That it is hereby determined that the taking of the tracts
and parcels of land set forth in Paragraph 3 hereof is necessary
for the public good in order that said tracts and parcels shall be
used for drainage purposes.
2. That the City shall take by right of eminent domain for
drainage purposes the lands described in Paragraph 3 hereof, and
the City Attorney be hereby authorized and directed to commence
proceedings in the District Court of Hennepin County for appointment
of Commissioners to determine the damages, if any, sustained by
the respective owners of the parcels affected by such taking, as
authorized by law, and
3. That the land above referred to is more particularly
described as follows:
A 10.00 feet permanent easement for storm sewer purposes over,
under, and across that part of the north half of Section 20,
Township 117 north, Range 21 west, Hennepin County, Minnesota.
The centerline of said easement is described as follows:
Commencing at the southwest corner of Lot 18, Block 57A,
Rearrangement of St. Louis Park according to the plat
on file in the Office of the Register of Deeds, Hennepin
County, Minnesota; thence northeasterly along the south
line of said Lot 18 a distance of 45.00 feet; thence
southeasterly at a right angle a distance of
5.00 feet to the point of beginning of the
centerline to be described; thence northeastly,
parallel with said south line of said Lot 18, a
distance of 75.00 feet; thence southeasterly at a
right angle a distance of 95.00 feet to the
northerly line of the Chicago, Milwaukee, St. Paul
and Pacific Railroad right-of-way and said
centerline there terminating.
Adopted by the City Council July 7, 1975.
