A RESOLUTION GRANTING PERMIT UNDER SECTION 6:122.17 OF
THE ZONING ORDINANCE FOR MODIFICATION AND EXPANSION OF A
CLASS I RESTAURANT FOR PROPERTY LOCATED IN THE B-2
GENERAL BUSINESS DISTRICT AT 5600 WAYZATA
BOULEVARD
Be it resolved by the City Council of the City of St. Louis Park:
Findings
1. Eddie Webster's,Incorporated, has made application to the City Council for
a special permit under Section 6:122.17 of the Zoning Ordinance for the purpose of
the modification and expansion of a Class I Restaurant located at 5600 Wayzata
Boulevard for the legal description as follows:
That part of Government Lot 5, Section 4, Township 117,
Range 21 lying North of U.S. Highway 12 and South of Wayzata
Boulevard subject to lot easement over the West 33 feet thereof
and subject to highway easement of the East 50 feet of the
West 436 feet thereof.
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 75 -41 -SP) and the effect of the proposed modifications to the
existing use on the health, safety, and welfare of the occupants of the surrounding
lands, existing and anticipated traffic conditions, the effect on values of properties
in the surrounding area and the effect of the use on the Comprehensive Plan.
3. The Council has determined that the modification to the existing use to
permit expansion and modification of the existing facility will not be detrimental
to the health, safety, or general welfare of the community nor will it cause serious
traffic congestion nor hazards, nor will it seriously depreciate surrounding property
values, and the proposed modifications to the use are in harmony with the general pur-
pose and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit modification and expansion of a Class I
Restaurant at the location described is granted based on the findings set forth above
and subject to the following conditions:
a) The site be developed, used, and maintained in accordance with Exhibit
A, Site Plan; Exhibit B, Basement Floor Plan; Exhibit C, First Floor
Plan; Exhibit D, Elevation Plans; and Exhibit E, Landscape Plan; and
Exhibit F, Lighting Plans, as modified by the Planning Department June 13,
1975, by requiring that the Russian Olive trees be a minimum of 6 feet in
height at the time of planting and that all other trees to be planted be
a minimum of 3 -inch in diameter, measure 1 foot off the ground at the time
of planting, and that the 3 parking stalls be modified at the east end of
the east parking lot, and that a sidewalk through the parking lot at the
west end of the building be linked to the sidewalk on the south side of
the building as shown on the modified plan.
And that all driveways be constructed as shown on the site plan with
concrete radiuses extending into the right of way, and that all such
areas between the radiuses extended and the property line be landscaped
with sodding and the vegetation as shown on the modified plans.
b) All building construction, curbing, paving, striping, landscaping,
sidewalks, and lighting shall be completed by June 1, 1976.
c) No parking shall be restricted for valet parking except in the parking
lot east of the principal building, and at the time valet parking is used
in said east lot, tandem parking may be permitted.
d) That fire lane provisions and necessary resolutions be considered to provide
suitable and uniform parking restrictions on both sides of the south
service road, extension of Yosemite Avenue, and on the south side of
Superior Boulevard adjacent to the subject property.
