RESOLUTION GRANTING VARIANCE OF LOT ,REA AND LOT WIDTH FROM -THE REQUIREMENTS OF SECTION 6:074.5 OF THE ST. LOUIS PARI: ZONING ORDINANCE WHEREAS, application has been made to the City Council by Reinhold N. Koch for variance from the requirements of Section 6:074.5 of the St. Louis Park Zoning Ordinance for the following purpose: To permit a lot width of 50 feet instead of the required 60 feet and a lot area of 6,500 square feet instead of 7,200 square feet for property located in the R-2 (Single Family) District. at the following location; to -wit: Lots 41 and 42, Block 318 Rearrangement of St. Louis Park commonly known as 3701 Quebec Avenue South WHEREAS, the Council has considered the advice and recommendation of the Board of Zoning Appeals (Case No. 73 -16 -VAR), and the effect of the proposed variance upon the health, safety, and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area and the effect of the proposed variance upon the Compre- hensive Plan, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park that it is hereby determined that the special conditions applying to the struc- ture or land in question are peculiar to such property or immediately adjoining property and do not apply generally to other land or structures in the district in which said land is located, and that the granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant and that granting the proposed variance will not impair an adequate supply of light and air to adjacent property, unreasonably increase the congestion in the public streets, increase the danger of fire, endanger the public safety, unreasonably diminish or impair established property values in the surrounding area, nor in any other way impair health, safety, comfort, morals, nor in any other respect be contrary to the intent of this ordinance and the Compre- hensive Plan, and that the granting of such variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable hardship or difficulty, and . r BE IT FURTHER RESOLVED that variance is hereby granted to the applicant for the purpose set forth, subject to the following condition: The garage on southerly portion of Lot 43 and northerly portion of Lot 42, Block 318 Rearrangement of St. Louis Park shall be removed within 60 days of the effective date of this resolution.
