HomeMy WebLinkAbout4672 - ADMIN Resolution - City Council - 1972/10/30ORIGINAL OCTOBER 30, 1972 5A RESOLUTION NO. 4672 RESOLUTION GIVING APPROVAL FOR FINAL PLAT OF DELMARK'S 1ST ADDITION WHEREAS, The Delr.1ark Company, a Minnesota corporation, owner and subdivider of the land proposed to be platted as Delmark's 1st Addition, have submitted their application for approval of final plat of said subdivision in the manner required for platting of land under the St. Louis Park Ordinance Code, and all proceedings have been duly had thereunder, and WHEREAS, said plat is in all respects consistent with the City Plan and the regulations and requirements of the Laws of the State of Minnesota and the ordinances of the City of St. Louis Park, and WHEREAS, said plat is s_tuate upon the following described lands in Hennepin County, Minnesota, to -wit: Delmark's 1st Addition, being that part of the Northwest 1/4 of the Northwest 1/4, Section 31, Township 29, Range 24, described as commencing at the point of intersection of the Southerly right of way line of the Great Northern Railway Company with the Westerly right of way line of State Trunk Highway No. 100; thence Southerly along the Westerly right of way line of said Highway 377.6 feet; thence Westerly parallel to the Southerly right of way line of ::a;d Railway Company 400 feet; thence Northerly at right ar_g10 3 250 feet to a point in the South right of way line of said Railway Company which point is the point of beginning; thence Northeasterly along said right of way lire 220 feet to the point in said right of way where the next course thereof extends in a Northwesterly direction; thence Northwesterly along said right of way line 80 feet; thence Southwesterly at right angles 220 feet; thence Southeasterly at right angles 30 feet to the point of beginning. That part of the Northwest 1/4 of the Northwest 1/4, Section 31, Township 29, Range 24, described as commencing at the point of intersection of the Southerly right of way line of the Great Northern Railway Cor_pany with the Westerly right of way line of State Trunk Hig:-way No. 100; thence Southerly along the Westerly right of way line of said Highway 377.6 feet; thence Westerly parallel to the Southerly right of way line of said Railway Company 140 feet to the point of beginning; thence ccntinuing Westerly along said parallel line 160 feet; thence Northerly at right angles 250 feet to the Southerly right of way line of said Railway Company; thence Easterly, Northerly and Easterly along said right of way line to its intersection with a line drawn Northerly, at right angles to said aforementioned parallel lire, from the point of beginning; thence Southerly 330 feet to the point of beginning. Tract C; Registered Land Survey No. 493; except the southeasterly 30.0 feet; measured at right angle to and parallel with the southeasterly line of said Tract C. together with That part of Tract A lying northwesterly of the Southwesterly extension of a line which lies 30 feet northwesterly of and parallel with the southeasterly line of Tract C and lying northeasterly of a line which lies 94.0 feet southwesterly of and parallel with the southwesterly line of Tract C; all located in REGISTERED LAND SURVEY NO. 493, Files of the Registrar of Titles, Hennepin County, Minnesota. That part of the Northwest Quarter of the Northwest Quarter of Section 31, Township 29, Range 24, Hennepin County, Minnesota described as follows: Beginning at the most northerly corner of Tract C, REGISTERED LAND SURVEY NO. 493; files of the Registrar of Titles, Hennepin County, Minnesota; thence northwesterly along the northwesterly extension of the northeasterly line of said Tract C a distance of 80.0 feet; thence southwesterly parallel with the northwesterly line of Tracts C and A of said REGISTERED LAND SURVEY NO. 493, a distance of 180.0 feet; thence southeasterly, at a right angle, a distance of 30.0 feet to the northwesterly line of said Tract A; thence northeasterly along said northwesterly line of Tracts A and C a distance of 180.0 feet to the point of beginning. BE IT RESOLVED by the City Council of the City of St. Louis Park: 1. That said plat of Delmark's 1st Addition is hereby approved and accepted by the City as being in accord and conformity with all ordinances, city plans and regulations of the City of St. Louis Park and the laws of the State of Minnesota, providel, however, that this approval is made subject to the approving opinion of the City Attorney as to the title and form and execution of the plat, and execution of a contract for any improvements remaining to be constructed by the subdivider, and bond thereunder, or the certificate of the City Treasurer certifying to a cash deposit in the amount required by the City Council as the estimated cost of improvements to be provided by the subdivider, and if such be the case, the City Engineer's certificate that the remaining improvements requiredcf the subdivider have been completely and properly installed, all as required by the provisions of Section 6:303-C-6, of the St. Louis Park Ordinance Code entitled "Certification by City Clerk". 2. That the City Clerk is hereby directed to file a certified copy of this Resolution in the office of the Register of Deeds and Registrar of Titles for their use as required by N.S.A. 471.29. 3. That the City Clerk is hereby directed to supply a certified copy of this Resolution to the above named owner and subdivider who is the applicant herein. -2- 4. That the Mayor and City Manager are hereby authorized to execute all contracts required herein, and the City Clerk is hereby directed to execute the certificate of approval on behalf of the City Council upon the said plat when all of the conditions set forth in paragraph No. 1 above and Section 6:303-C-6 of the St. Louis Park Ordinance Code have been fulfilled. 5. That the owners grant a deed to the City of St. Louis Park for pedestrian easement ovet'the southerly six feet of the proposed plat. BE IT FURTHER RESOLVED that such execution of the certificate upon said plat by the City Clerk, as required under Section 6:303-C-6, shall be conclusive showing of proper compliance therewith by the subdivider and City officials charged with duties above described and shall entitle such plat to be placed of record forthwith without further formality.
