RESOLUTION OF
CLARIFICATION OF CITY COUNCIL'S
POLICY ON PAVING, CURB AND GUTTER IMPROVEMENTS
WHEREAS, in years prior to 1966, the City Council's policy for
construction of paving, curb and gutter improvements was to assess at
total costs to all of the benefited property, pursuant to provisions
of Minnesota Statutes, Chapter 429, and
WHEREAS, for certain types of Improvements, the City Council has
established various assessment policies designating a variable rate schedule
for residential properties versus properties of a commercial and industrial
nature, and
WHEREAS, the City Council's assessment policy approved April 25, 1966
did not provide any clarified provision on the application of the $3.25
per front foot for curb and gutter and $4.75 per front foot for paving,
involving houses located on lands zoned for other uses, except to say
"street in front of house", and
WHEREAS, the City Council's assessment policy approved May 1, 1972
did not provide any clear directive on the application of the per front
foot cost formula involving houses or other properties located on lands
zoned for other uses, therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park that:
1. The intent of the City Council at the time it passed the special
assessment policy on assessments for paving, curb and gutter improvements
was to apply the per front foot cost formula policy of $8.00 per front
foot, as amended May 1, 1972 to all benefiting lands occupied by single
or double family houses and used exclusively for family housing purposes.
2. The per front foot cost formula policy of $8.00 per front foot,
as amended May 1, 1972 would apply to all vacant lands zoned R-1 or R-2.
3. All lands occupied by churches not in excess of their reasonable
needs and used actively and exclusively for religious purposes shall be
assessed at the prevailing rate applying to single or double family houses.
4. All other lands zoned or used for purposes other than those
described in 1, 2 or 3 above shall be assessed at costs, and
BE IT FURTHER RESOLVED that henceforth the Council's policy on paving
and curb and gutter improvements shall be known as "The Residential Single
and Double Family per Front Foot Cost Formula" and shall be based upon the
cost formulas adopted by the Council May 1, 1972.
