HomeMy WebLinkAbout4546 - ADMIN Resolution - City Council - 1972/06/19JUNE 19, 1972 ORIGINAL 5B RESOLUTION NO. 4546 RESOLUTION GRANTING VARIANCE IN FRONT AND REAR YARD DEPTH FROM THE REQUIREMENTS OF SECTION 6:064.5 OF THE ST. LOUIS PARK ZONING ORDINANCE WHEREAS, application has been made to the City Council by John R. Rydell for variance from the requirements of Section 6:064.5 of the St. Louis Park Zoning Ordinance for the following pr' -:^se: To permit the division of a lot to permit a rear yard depth of 20 feet instead of the required 35 feet on the easterly portion of the lot and to permit a front yard depth of 30 feet and a rear yard depth of 25 feet instead of the required 35 feet on the westerly portion of the lot for property located in R-1 (Single Family) District at the following location, to -wit: Lot 7, Block 2, Broe--ide 2nd Division commonly known as 4244 Alabama Avenue and approximately 4251 Meadowbrook Boulevard WHEREAS, the Council has considered the advice and recommendations of the Board of Zoning Appeals (Case No. 72 -16 -VAR) and the effect of the proposed variance upon the health, safety, and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area and the effect of the proposed variance upon the Comprehensive Plan, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park that it is hereby determined that the special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property, and do not apply generally to other land or structures in the district in which said land is located, and that the granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant and that granting of the proposed variance will not impair an adequate supply of light and air to adjacent property, unreasonably increase the congestion in the public streets, increase the danger of fire, endanger the public safety, un- reasonably diminish or impair health, safety, comfort, morals, nor in any other respect be contrary to the intent of this ordinance and the Comprehensive Plan, and that the granting of such variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable hardship or difficulty, and BE IT FURTHER RESOLVED that variance is hereby granted to the applicant for the purpose above set forth.
