RESOLUTION AND ORDER FOR REMOVAL OF
SUBSTANDARD DWELLING AT 5920 WEST 41ST
STREET AS A HAZARDOUS BUILDING
WHEREAS, pursuant to Chapter 393 of the Laws of Minnesota, 1965, and
Chapter 324 of the Laws of Minnesota, 1967, (M.S.A. 463.15-26) the
Building Inspector has filed his report on a two story frame building
at 5920 West 41st Street, St. Louis Park, Minnesota, to -wit:
That part lying Easterly of Westerly 93 feet front and
rear of Lot 13, Block 5, Suburban Homes Company Addition
and
WHEREAS, the City is authorized to certify the expense of such demolition
as a special assessment against said lands in accordance with Section 463.21
of Minnesota Laws 1967, to be certified in the Hennepin County Land
Department, Room 103, Court House, Minneapolis, Minnesota, in the manner of
certification of special assessments for local improvements under Minnesota
Statutes 1961, Sections 429.061 to 429.081, therefore
BE IT RESOLVED by the City Council of the City of St. Louis Park:
1. That the City Council on the date of this resolution has duly heard
and considered the matter and hereby finds and determines that the above
described buildings upon the above described lands are hazardous and
substandard upon the following grounds:
The following items of deficiency exist in the existing dwelling and
accessory buildings at 5920 West 41st Street under the Housing Code of the
City of St. Louis Park, Chapter 10, Sections:
B. Inadequate Sanitation

1. Plumbing not vented properly and anti -siphon ballcock required
in flush tank.
3. Kitchen sink not vented.
10. There is a lack of required receptacles in most rooms.
11. Bathroom very damp due to roof leakage. Walls and ceiling water
soaked.
13. General dilapidation has set in due to lack of maintenance.
14. The house is not connected to sanitary sewer and the well is
contaminated as per water test at Edina Lab.
C. Structural Hazards
2. Several floor joists have rotted and some are cut and split.
6. Roof rafters have rotted due to water leakage and the kitchen
ceilings sgas very badly.
7. Ceiling and roof rafters are of insufficient size to carry a
safe load.
D. Nuisance
(B) The property is vacant and is an attraction to children.
(H) Water from the well is contaminated and could be a health problem
E. Hazardous Wiring
The house will have to be completely rewired because of cut and
spliced wiring, open boxes, and B -X wiring which has become wet and
rusted. There is a lack of receptacles throughout the house and the
service has been overfused to a dangerous condition.
F. Hazardous Plumbing
Open sewer line allowing gas and odors into the house.
H. Faulty Weather Protection
1. Ceilings in most rooms are in very poor condition due to the
leaking roof.
2. Water leaks into the house under the back which has caused the
threshold and floor joist under it to rot out. Also water backs
into the kitchen ceiling from faulty roofing.
3. The house and all trim around doors and windows show a complete
lack of paint.
I. Inadequate Maintenance
The house has become very dilapidated due to the lack of proper
maintenance over the years. The house has been vacant for some
time and is now becoming an attraction to the children in the
neighborhood. The entrance to the basement is outside of the
house and this is a very hazardous condition.
This entire structure and accessory buildings have deteriorated from age,
lack of maintenance and obsolescence to a point that it is completely
impossible as well as impractical to repair or renovate.
That there is no knoggitem of personal property of a nature or value
to be salvaged on said premises.

The buildings necessitate complete removal and filling of excavation.
2. That pursuant to the foregoing and in accordance with Chapter 393
of the Laws of Minnesota, 1965, as amended, IT IS HEREBY ORDERED BY THE
CITY COUNCIL OF THE CITY OF ST. LOUIS PARK that the above said hazardous
buildings be razed or removed by the City Manager with City forces or by
contractor, and
3. That it is further ordered by the Council that all personal property,
if any be discovered, of a nature or value so as to be removed, it shall be
removed and the Manager shall sell such personal property or fixtures at
public auction.
4. That the City Manager, officers and employees of the City are
further authorized and directed to take whatever action, prepare and sign
such papers, orders and certificates necessary to comply with this order
and to assess the costs thereof against the real estate, to be collected
as special assessments.
