HomeMy WebLinkAbout4536 - ADMIN Resolution - City Council - 1972/06/05ORIGINAL JUNE 5, 1972 7K RESOLUTION N0.436 RESOLUTION AND ORDER FOR REMOVAL OF SUBSTANDARD DWELLING AT 4161 ZARTHAN AVENUE AS A HAZARDOUS BUILDING WHEREAS, pursuant to Chapter 393 of the Laws of Minnesota, 1965, and Chapter 324 of the Laws of Minnesota, 1967, (M.S.A. 463.15-26) the Building Inspector has filed his report on a one 1 story frame dwelling unit at 4161 Zarthan Avenue, St. Louis Park, Minnesota, to -wit: Lot 23, and south one-half of Lot 24, Block 7, Suburban Homes Company Addition and WHEREAS, the City is authorized to certify the expense of such demolition as a special assessment against said lands in accordance with Section 463.21 of Minnesota Laws 1967, to be certified to the Hennepin County Land Department, Room 103, Court House, Minneapolis, Minnesota, in the manner of certification of special assessments for local improvements under Minnesota Statutes 1961, Sections 429.061 to 429.081, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park: 1. That the City Council on the date of this resolution has duly heard and considered the matter and hereby finds and determines that the above described buildings upon the above described lands are hazardous and substandard upon the following grounds: The following items of deficiency exist in the existing dwelling and accessory buildings at 4161 Zarthan Avenue under the Housing Code of the City of St. Louis Park, Chapter 10, Sections: B. Inadequate Sanitation 5. Lack of hot and cold water in a dwelling unit. Water has been turned off due to vacancy. 6. Lack of heating facilities. No central heating system in the dwelling unit. 10. Lack of required electrical lighting. Service is disconnected. 30 Amp service is inadequate. 11. Dampness of habitable rooms. Windows broken and house has been open to the elements. 13. General dilapidation and lack of maintenance. House has been vacant for over a year. Roof appears to be in very poor repair. C. Structural Hazards 1. Deteriorated or inadequate foundation. The dwelling unit has a partial basement and parts of this are caving in weakening the structure. 2. Defective floor supports. 2 x 6 floor joists have been cut and spliced. 3. Floor supports of insufficient size to carry loads with safety. 2 x 6 floor joists over spanned, beam filled and rotted. D. Nuisance (b) The house has become an attraction to children in the neighborhood which may prove to be detrimental. (f) Unsanitary sewage and plumbing facilities. E. Hazardous Wiring Wiring is cut and spliced. B -X type wiring hanging loose in basement area. Fixtures and receptacles hanging loose in a dangerous condition. F. Hazardous Plumbing There is an open sewer pipe in the basement and the traps are dry allowing sewer gas into the premises. The pressure and temperature relief valve is plugged on the water heater. H. Faulty Weather Protection Vindows have all been broken in the house and the roof is in very poor condition. Paint is lacking on the exterior of the house leaving it in a very weathered appearance. K. Hazardous or Unsanitary Premises. There is an accumulation of broken glass, trash, rubbish, weeds and brush on the premises. This entire structure and accessory buildings have deteriorated from age, lack of maintenance and obsolescence to a point that it is completely impossible as well as impractical to repair or renovate. That there is no known item of personal property of a nature or value to be salvaged on said premises. The buildings necessitate complete removal and filling of excavation. -2- 2. That pursuant to the foregoing and in accordance with Chapter 393 of the Laws of Minnesota, 1965, as amended, IT IS HEREBY ORDERED BY THE CITY COUNCIL OF THE CITY OF ST. LOUIS PARK that the above said hazardous buiBings be razed or removed by the City Manager with City forces or by contractor, and 3. That it is further ordered by the Council that all personal property, if any be discovered, of a nature or value so as to be removed, it shall be removed and the Manager shall sell such personal property or fixtures at public auction. 4. That the City Manager, officers and employees of the City are further authorized and directed to take whatever action, prepare and sign such papers, orders and certificates necessary to comply with this order and to assess the costs thereof against the real estate, to be collected as special assessments.
