HomeMy WebLinkAbout4533 - ADMIN Resolution - City Council - 1972/06/05ORIGINAL JUNE 5, 1972 7H RESOLUTION NO. 4533 RESOLUTION AND ORDER FOR REMOVAL OF SUBSTANDARD DWELLING AT 4065 XENWOOD AVENUE AS A HAZARDOUS BUILDING WHEREAS, pursuant to Chapter 393 of the Laws of Minnesota, 1965, and Chapter 324 of the Laws of Minnesota, 1967, (M.S.A. 463.15-26) the Building Inspector has filed his report on a one 1 story frame dwelling, one detached garage at 4065 Xenwood Avenue, St. Louis Park, Minnesota, to -wit: Lot 25, Block 2, Suburban Homes Company Addition and WHEREAS, the City is authorized to certify the expense of such demolition as a special assessment against said lands in accordance with Section 463.21 of Minnesota Laws, 1967, to be certified to the Hennepin County Land Department, Room 108, Court House, Minneapolis, Minnesota in the manner of certification of special assessments for local improvements under Minnesota Statutes 1961, Sections 429.061 to 429.081, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park: 1. That the City Council on the date of this resolution has duly heard and considered the matter and hereby finds and determines that the above described buildings upon the above described lands are hazardous and substandard upon the following grounds: The following items of deficiency exist in the existing dwelling and accessory buildings at 4065 Xenwood Avenue under the Housing Code of the City of St. Louis Park, Chapter 10, Sections: B. Inadequate Sanitation 1. Lack of or improper water closet, lavatory, bath tub or shower in a dwelling unit. The lavatory is not vented, an anti -siphon ballcock is required and the shower base has deteriorated allowing water to penetrate the floor. 11. Dampness of habitable rooms. The roof leaks water into most rooms of the dwelling unit. 13. General dilapidation or improper maintenance. Proper maintenance has been lacking for some time. Windows are rotted and the front door no longer is serviceable. Paint is lacking on the trim. F C. Structural Hazards 1. Deteriorated or inadequate foundations. Proper foundation is lacking under two sections of the house. 3. Defective or deteriorated floor supports. Floors sag throughout the house. 2 x 6 floor joist 24 inches on center are not sufficient to carry the load. 7. Members of ceilings, roof, ceiling and roof supports that are of insufficient size to carry imposed loads with safety. 2 x 4 rafters have sagged allowing the ceilings to separate from the walls in several places. The roof leaks and the ceilings have deteriorated in the bathroom and bedroom. The roof ridge has sagged and this is carried down through the interior of the dwelling. D. Nuisance (b) There is much trash and litter on the premises and the house is open which may be detrimental to inquisitive minors. E. Hazardous Wiring Wiring in the basement area is B -X type and Rom -X which is not approved. tiring has been cut and spliced and is hanging loose. The service is not properly grounded. F. Hazardous Plumbing Fixtures are not properly vented H. Faulty Weather Protection 1. Ceiling tiles are deteriorated and hanging loose in the bathroom and bedroom due to the leaking roof. 2. The house sits too low to the grade allowing moisture to penetrate the walls causing rot around the perimeter of the house. Windows do not close properly allowing moisture into the interior of the dwelling. 3. Paint is lacking on most windows and trim. 4. The roof has rotted very severely over the back portion of the dwelling unit. K. Unsanitary Premises Weeds, old fence material, trash and litter have been allowed to remain on the premises. This entire structure and accessory buildings have deteriorated from age, lack of maintenance and obsolescence to a point that it is completely impossible as well as impractical to repair or renovate. That there is no known item of personal property of a nature or value to be salvaged on said premises. -2- The buildings necessitate complete removal and filling of excavation. 2. That pursuant to the foregoing and in accordance with Chapter 393 of the Laws of Minnesota, 1965, as amended, IT IS HEREBY ORDERED BY THE CITY COUNCIL OF THE CITY OF ST. LOUIS PARK that the above said hazardous buildings be razed or removed by the City Manager with City forces or by contractor, and 3. That it is further ordered by the Council that all personal property, if any be discovered, of a nature or value so as to be removed, it shall be removed and the Manager shall sell such personal property or fixtures at public auction. 4. That the City Manager, officers and employees of the City are further authorized and directed to take whatever action, prepare and sign such papers, orders and certificates necessary to comply with this order and to assess the costs thereof against the real estate, to be collected as special assessments.
