HomeMy WebLinkAbout4532 - ADMIN Resolution - City Council - 1972/06/05ORIGINAL JUNE 5, 1972 7G RESOLUTION NO. 4532 RESOLUTION AND ORDER FOR REMOVAL OF SUBSTANDARD DWELLING AT 4300 WEST 28TH STREET AS A HAZARDOUS BUILDING WHEREAS, pursuant to Chapter 393 of the Laws of Minnesota, 1965, and Chapter 324 of the Laws of Minnesota, 1967, (M.S.A. 453.15-26), the Building Inspector has filed his report on a two story frame dwelling at 4300 West 28th Street, St. Louis Park, Minnesota, to -wit: The East 140 feet of the West 433 feet of the following described tract: Commencing 884.2 feet East of the Southwest corner of the Northwest quarter of the Southeast quarter; thence East 792.6 feet; thence Northwesterly to a point 297.2 feet North of the point of beginning; thence South to the point of beginning; All in Section 31, Township 29, Range 24, except the south 27k feet thereof, conveyed to the Village of St. Louis Park for street purposes. Otherwise known as Parcel No. 6440. and WHEREAS, the City is authorized to certify the expense of such demolition as a special assessment against said lands in accordance with Section 463.21 of Minnesota Laws 1967, to be certified to the Hennepin County Land Department, Room 108, Court House, Minneapolis, Minnesota, in the manner of certification of special assessments for local improvement under Minnesota Statutes 1961, Sections 429.061 to 429.031, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park: 1. That the City Council on the date of this resolution has duly heard and considered the matter and hereby finds and determines that the above described buildings upon the above described lands are hazardous and substandard upon the following grounds: The following items of deficiency exist in the existing dwelling and accessory buildings at 4300 West 28th Street under the Housing Code of the City of St. Louis Park, Chapter 10, Sections: B. Inadequate Sanitation 1. Unvented plumbing to fixtures 3. Kitchen sink unvented 5. Lack of hot water 6. Heating plant has been frozen and pipes and radiator are cracked and broken. 10. All electric fixtures and switches have been removed. 13. Lack of maintenance throughout. C. Structural Hazards 1. Foundation and footings lacking or deteriorated. 2. Several floor joist show signs of rotting and sagging. 3. Posts are buried in the cement floor and dry rot is prevalent. 6. The porch roof sags very badly and roof rafters have been cut where the old chimney went through the roof. D. Nuisance (b) The house is vacant and is an attraction to children in the neighborhod. E. Hazardous Wiring Anti -siphon ballcock required and venting is lacking. G. Hazardous Mechanical Equipment The heating plant will have to be replaced. H. Faulty Weather Protection There is a lack of paint on trim and windows, window casings are very rotted and windows are broken and missing. K. Hazardous or unsanitary premises. There is much trash and litter on the property. Weeds and brush cover much of the property and this has not been cut in several years. L. Inadequate Maintenance The back entry shed has no footings and has rotted out at the bottom leaving the walls flexible. The roof has sagged and shows signs of rotting. Windows and casings are in very poor condition. Several windows are broken or missing. The house is vacant and could be a target for arson. This entire structure and accessory building have deteriorated from age, lack of maintenance and obsolescence to a point that it is completely impossible as well as impractical to repair or renovate. That there is no known item of personal property of a nature or value to be salvaged on said premises. The buildings necessitate complete removal and filling of excavation. -2- 2. That purst to the foregoing and in accordance with Chapter 393 of the Laws of Minnesota, 1965, as amended, IT IS HEREBY ORDERED BY THE CITY COUNCIL OF THE CITY OF ST. LOUIS PARK that the above said hazardous buildings be razed or removed by the City Manager with City forces or by contractor, and 3. That it is further ordered by the Council that all personal property, if any be discovered, of a nature or value so as to be removed, it shall be removed and the Manager shall sell such personal property or fixtures at public auction. 4. That the City Manager, officers and employees of the City are further authorized and directed to take whatever action, prepare and sign such papers, orders and certificates necessary to comply with this order and to assess the costs thereof against the real estate, to be collected as special assessments.
