HomeMy WebLinkAbout4531 - ADMIN Resolution - City Council - 1972/06/05ORIGINAL June 5, 1972 7F RESOLUTION NO. 4531 RESOLUTION AND ORDER FOR REMOVAL OF SUBSTANDARD DWELLING AT 4335 EXCELSIOR BOULEVARD AS A HAZARDOUS BUILDING WHEREAS, pursuant to Chapter 393 of the Laws of Minnesota, 1965, and Chapter 324 of the Laws of Minnesota, 1967, (M.S.A. 463.15-26) the Building Inspector has filed his report on a two story frame building, one detached garage at 4335 Excelsior Boulevard, St. Louis Park, Minnesota, to wit: Lots 6 and 7 except State Highway, Bassford's Addition and WHEREAS, the City is authorized to certify the expense of such demolition as a special assessment against said lands in accordance with Section 463.21 of Minnesota Laws 1967, to be certified to the Hennepin County Land Department, Room 108, Court House, Minneapolis, Minnesota, in the manner of certification of special assessments for local improvements under Minnesota Statutes 1961, Sections 429.061 to 429.081, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park: 1. That the City Council on the date of this resolution has duly heard and considered the matter and hereby finds and determines that the above described buildings upon the above described lands are hazardous and substandard upon the following grounds: The following items of deficiency exist in the existing dwelling and accessory buildings at 4335 Excelsior Boulevard under the Housing Code of the City of St. Louis Park, Chapter 10, Sections: B. Inadequate Sanitation 1. Lack of water closet 5. Lack of hot and cold water 6. No heating facilities 10. Lack of required electrical lighting. 13. General dilapidation due to lack of maintenance, windows broken and house is open to the elements. C. Structural Hazards 2. The flooring has buckled due to water entering from broken windows. D. Nuisance (b) Attraction to children which may prove to be detrimental (f) Plumbing fixtures frozen and broken. E. Hazardous Wiring Receptacles and fixtures broken and missing. Service not connected at this time. Grounding is necessary. Basement will have to be rewired. F. Hazardous Plumbing Toilet broken and hand lavy has been removed leaving an open sewer line. Kitchen sink removed G. Hazardous Mechanical Equipment Hot water heating plant has frozen and broken and will have to be replaced. H. Faulty Weather Protection 2. Roof is very poor and leaks in several places. Windows have been broken and are boarded up at this time. Doors have been broken into and are open to the elements most of the time. 3. All trim is in need of paint and facia boards are rotting because of lack of maintenance. K. Hazardous Unsanitary Premises The property is overgrown with weeds and bushes that need trimming. There is a large amount of trash including old Xmas trees, tires, lumber, paper and miscellaneous items. I. Inadequate Maintenance There has been a complete lack of maintenance for years at this property. The doors have broken open and kids get into the house, which is very dark inside and this can be dangerous due to falls on stairways or stepping into broken glass and litter in the house. The house is becoming dilapidated and could become a target for arson. This entire structure and accessory buildings have deteriorated from age, lack of maintenance and obsolescence to a point that it is completely impossible as well as impractical to repair or renovate. That there is no known item of personal property of a nature or value to be salvaged on said premises. -2- The buildings necessitate complete removal and filling of excavation. 2. That pursuant to the foregoing and in accordance with Chapter 393 of the Laws of Minnesota, 1965, as amended, IT IS HEREBY ORDERED BY THE CITY COUNCIL OF THE CITY OF ST. LOUIS PARK that the above said hazardous buildings be razed or removed by the City Manager with City forces or by contractor, and 3. That it is further ordered by the Council that all personal property, if any be discovered, of a nature or value so as to be removed, it shall be removed and the Manager shall sell such personal property or fixtures at public auction. 4. That the City Manager, officers and employees of the City are further authorized and directed to take whatever action, prepare and sign such papers, orders and certificates necessary to comply with this order and to assess the costs thereof against the real estate, to be collected as special assessments.
