RESOLUTION AND ORDER FOR REMOVAL OF
SUBSTANDARD DWELLING AT 4525 MINNETONKA
BOULEVARD AS A HAZARDOUS BUILDING
WHEREAS, pursuant to Chapter 393 of the Laws of Minnesota, 1965, and
Chapter 324 of the Laws of Minnesota, 1967, (M.S.A. 463.15-26) the
Building Inspector has filed his report on two onastory frame buildings
at 4525 Minnetonka Boulevard, St. Louis Park, Minnesota, to wit:
North 258 feet of east one-third of west 3/3 of northwest
one-quarter of northeast one-quarter except streets,
Section 6, Township 28, Range 24
and
WHEREAS, the City is authorized to certify the expense of such demolition
as a special assessment against said lands in accordance with Section 463.21
of Minnesota Laws 1967, to be certified to the Hennepin County Land Department,
Room 108, Court House, Minneapolis, Minnesota, in the manner of certification
of special assessments for local improvements under Minnesota Statutes 1961,
Sections 429.061 to 429.081, therefore,
BE IT RESOLVED by the City Council of the City of St. Louis Park:
1. That the City Council on the date of this resolution has duly heard
and considered the matter and hereby finds and determines that the above
described buildings upon the above described lands are hazardous and
substandard upon the following grounds:
The following items of deficiency exist in the existing dwelling and
accessory buildings at 4525 Minnetonka Boulevard under the Housing Code of
the City of St. Louis Park, Chapter 10, Sections:
B, Inadequate Sanitation
1.
Lack of or improper water closet, lavatory, bath tub or
shower in a dwelling unit. Fill spigot below the fill line
on the bath tub, anti -siphon ballcock required in flush tank
and the water has been shut off leaving all traps dry.
3. Improper kitchen sink. Sink is not vented properly.
5. Lack of hot and cold running water. Water has been disconnected
to the dwelling.
10. Lack of required electrical lighting. The service has been
disconnected and vandals have removed all fixtures from the house.
11. Dampness of habitable rooms. Windows have been broken allowing
rain and snow into the interior.
13. General dilapidation or improper maintenance. There has been a
lack of maintenance over a period of years.
14. Lack of connection to required sewage disposal system.
D. Nuisance
(b) The house is open and an attractive nuisance which may prove
detrimental to inquisitive minors.
Inadequate and unsanitary sewage and plumbing facilities.
(f)
(g) Uncleanliness. Trash and rubbish in the basement.
E. Hazardous Wiring
30 amp service. All fixtures removed and bare wires are visible
throughout the house.
F. Hazardous Plumbing
Not connected to sanitary sewer
H. Faulty Weather Protection
2. Windows are broken and the doors are not secure and are left
open most of the time.
This entire structure and accessory building have deteriorated from age,
lack of maintenance and obsolescence to a point that it is completely impossible
as well as impractical to repair or renovate.
That there is no known item of personal property of a nature or value
to be salvaged on said premises.
The buildings necessitate complete removal and filling of excavation.
2. That pursuant to the foregoing and in accordance with Chapter 393
of the Laws of Minnesota, 1965, as amended, IT IS HEREBY ORDERED BY THE
CITY COUNCIL OF THE CITY OF ST. LOUIS PARK that the above said hazardous
buildings be razed or removed by the City Manager with City forces or
by contractor, and
3. That it is further ordered by the Council that all personal
property, if any be discovered, of a nature or value so as to be removed
it shall be removed and the Manager shall sell such personal property or
fixtures at public auction.

4. That the City Manager, officers and employees of the City are
further authorized and directed to take whatever action, prepare and
sign such papers, orders and certificates necessary to comply with
this order and to assess the costs thereof against the real estate,
to be collected as special assessments.
