HomeMy WebLinkAbout4529 - ADMIN Resolution - City Council - 1972/06/05• ORIGINAL JUNE 5, 1972 7D RESOLUTION NO. 4529 RESOLUTION AND ORDER FOR REMOVAL OF SUBSTANDARD DWELLING AT 3341 DAKOTA AVENUE AS A HAZARDOUS BUILDING WHEREAS, pursuant to Chapter 393 of the Laws of Minnesota, 1965, and Chapter 324 of the Laws of Minne3ota, 1967, (M.S.A. 463.15-26) the Building Inspector has filed his report on a two story frame building at 3341 Dakota Avenue, St. Louis Park, Minnesota, to -wit: That part of Lot 9 and of that part of Lot 8, lying North of a line running from a point in the East line thereof distant 8 feet South of the Northeast corner of said Lot 8 to a point in the West line of said Lot 8, distant 8 feet south of the Northwest corner thereof, Block 5, Maple Park Addition to St. Louis Park north lying North and West of a line drawn diagonally from the southwesterly corner of Lot 7 said Block to the north- easterly corner of said Lot 9, according to the map or plat thereof on file or of record in the office of the Register of Deeds in and for Hennepin County, State of Minnesota and WHEREAS, the City is authorized to certify the expense of such demolition as a special assessment against said lands in accordance with Section 463.21 of Minnesota Laws 1967, to be certified to the Hennepin County Land Department, Room 108, Court House, Minneapolis, Minnesota, in the manner of certification of special assessments for local improvements under Minnesota Statutes 1961, Sections 429.061 to 429.081, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park: 1. That the City Council on the date of this resolution has duly heard and considered the matter and hereby finds and determines that the above described buildings upon the above described lands are hazardous and substandard upon the followiig grounds: The following items of deficiency exist in the existing dwelling and accessory building at 3341 Dakota Avenue under the Housing Code of the City of St. Louis Park, Chapter 10, Sections: B. Inadequate Sanitation: 1. Improper plumbing fixtures. Not vented correctly. Tub has submerged fill spigot. Anti -siphon ballcock required. Sewer plugged. 3. Kitchen sink not vented. 13. General dilapidation or improper maintenance. Doors and windows sag and do not fit properly. Handrails are missing. Both front and rear porches are rotted and sag very badly. C. Structural Hazards 1. Footings and foundation lacking or deteriorated. 2. Floor joists have been cut and spliced. Joists are overspanned in basement. Bathroom floor very rotted and deteriorated. Second story floors sag about 6 inches. 3. The floor joisted flooring on front porch have rotted completely through. Floors, floor joists and posts sag throughout the house. 4. The exterior walls appear to be buckling and bulging and the stucco has cracked or is missing due to foundation failures. 6. Roof rafters in the kitchen area have split and rotted. The roofing has leaked over a period of time and much deterioration is evident. The ridge sags approximately 3 inches. 7. Roof rafter in the kitchen area are 2 x 4 and will not carry imposed loads safely. Floor joist on second floor are no longer safe and will not carry an imposed load. E. Hazardous Wiring B -X type wire is exposed on the exterior wall of the house in the entry. This must be replaced with conduit. B -X wiring under the floor joists must be replaced with conduit. Open wiring in the kitchen area will have to be replaced. Add a switch to the bathroom light and ground the service on the street side of the water meter. F. Hazardous Plumbing Covered in B-1 H. Faulty weather protection Stucco missing from a large area on north side of house. The stucco is cracked and buldges in several areas around the house and foundation. K. The yard had not been maintained and a large amount of refuse is piled in back yard. Also 1 junk vehicle parked in back. This entire structure and accessory buildings have deteriorated from age, lack of maintenance and obsolescence to a point that it is completely impossible as well as impractical to repair or renovate. That there is no known item of personal property of a nature or value to be salvaged on said premises. The buildings necessitate complete removal and filling of excavation. -2- 2. That pursuant to the foregoing and in accordance with Chapter 393 of the Laws of Minnesota, 1965, as amended, IT IS HEREBY ORDERED BY THE CITY COUNCIL OF THE CITY OF ST. LOUIS PARK that the above said hazardous buildings be razed or removed by the City Manager with City forces or by contractor, and 3. That it is further ordered by the Council that all personal property, if any be discovered, of a nature or value so as to be removed, it shall be removed and the Manager shall sell such personal property or fixtures at public auction. 4. That the City Manager, officers and employees of the City are further authorized and directed to take whatever action, prepare and sign such papers, orders and certificates necessary to comply with this order and to assess the costs thereof against the real estate, to be collected as special assessments.
