HomeMy WebLinkAbout4467 - ADMIN Resolution - City Council - 1972/03/20ORIGINAL MARCH 20, 1972 8F RESOLUTION NO. 4467 RESOLUTION CALLING PUBLIC HEARING ON IMPROVEMENT NO. 72-23 WHEREAS, preliminary reports on this improvement have been prepared by the City Engineer pursuant to Council direction, which indicate that the improvement is feasible and shoull best be made as proposed and not in conjunction with any other improvement, and that the estimated cost of the improvement as recommended is $94,869.60, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park: 1. The Council will consider in accordance with those reports the following improvement: Improvement No. 72-23, construct and install storm sewer in drainage area bounded in general by Minnehaha Creek on the South; Edgewood Avenue on the East; Chicago Milwaukee and St. Paul Railway on the North and Meadowbrook Road on the West 2. The area proposed to be assessed for the cost of the improvement includes all lots, tracts or parcels of land lying within the portion of the city above described, for all or a portion of the cost of.the improve- ment, pursuant to Minnesota Statutes, Chaptcr 429. 3. A public hearing shall be held on this improvement on April 3, 1972 at 8:00 p.m. in the City Hall. The clerk shall give notice of this hearing as required by law. J R RITCHAY, being duly sworn, on oath says he is and during all times here stated has been the vice president and printer of the newspaper known as The St Louis Park Sun and has full knowledge of the facts herein stated as follows (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches (2) Said newspaper is a weekly and is distributed at least once each week (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements (4) Said newspaperis circulated in and near the municipality which it purports to serve, has at least lik500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total lation currently paid or no more than three months in arrears and has entry as second-class er m its local post -office (5) Said newspaper purports to serve the City of St Louis Park the County of Hennepin and it has its known office of issue in the City of Bloomington in said county, estabhshed and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the news- paper and business related thereto (6) Said newspaper files a copy of each issue immediately with the State Historical Society (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the publisher of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper He further states on oath that the printed Notice of Hearing hereto attached as a part hereof was cut from the columns of said newspaper, and was printed and published therein in the English language, once each week, for two iuiccessive weeks, that it was first so published on Thure the 23rd day of Mar 1972 and was thereafter printed and published on every Thure to and including urs the 30th day of Mar 19 72 and that the following is a printed copy e lower case alphabet from A to Z, both inclusive, and is hereby acknowledged as being size and kind of type used m the composition and publication of said notice, to -wit abcdefghijklmnopqrstuvwxyz abcdefghilk lmnopgrstuvwzvz Subscribed and sworn to before me thio 30th day of Mar , 19 72 (Notarial Seal) J.
