HomeMy WebLinkAbout4450 - ADMIN Resolution - City Council - 1972/02/28ORIGINAL FEBRUARY 23, 1972 7B3 RESOLUTION NO. 4450 RESOLUTION AUTHORIZING THE CITY MANAGER TO FILE AN APPLICATION FOR A FEDERAL GRANT TO ACQUIRE OPEN SPACE LAND (PLAN "C") WHEREAS, Title VII of the Housing Act of 1961, as amended, provides for the making of grants by the Secretary or Ilousin: and Urban Development to States and local public bodies to assist them in the acquisition and development of permanent interests in land for open -space uses where such assistance is needed for carrying out a unified or officially coordinated program for the provision and development of open -space land as part of the comprehensively planned development of the urban area; and WHEREAS, the City of St. Louis Park (herein sometimes referred to as "Applicant") desires to acquire Fee Simple Title to certain lands known as Parcel A-1, 4.509 acres, the ?'est Half of Lot 9, also Lots 10, 11, 12, 13, 14 and 15, all in Block 2, MURRI-MAC INDUSTRIAL PARK ADDITION-REPLAT, according to the recorded plat thereof on file or of record in the office of the Register of Deeds, Hennepin County, Minnesota; Parcel A-2, 6.547 acres, Lots 3, 4, 5, 6, 7 and 3 and the East Half of Lot 9, Block 2, MURRI-MAC INDUSTRIAL PARK ADDITION-REPLAT, according to the recorded plat thereof on file or of record in the office of the Register of Deeds, Hennepin County, Minnesota; Parcel A-3, 3.034 acres, that part of Lot 2, Block 2, MURaI-MAC INDUSTRIAL PARK ADDITION-REPLAT, according to the recorded plat thereof on file or of record in the office of the Register of Deeds, Hennepin County, Minnesota lying southerly of the following described line: Beginning at the southeast corner of Lot 1 of said Block 2; thence South 12°09'47" East, assumed bearing along the westerly line of said Lot 2 a distance of 34.39 feet to the point of beginning of the line to be described; thence bearing East a distance of 274.67 feet; the North 01004'53" East a distance of 310.23 feet; thence bearing East a distance of 354.22 feet to the east line of said Lot 2, Block 2, and said line there terminating; and Parcel A-4, 2.252 acres, the south 325.61 feet, measured at right angles to and parallel with the south line of the following described property: Beginning at the southwest corner of SE 1/4 of the NE 1/4 of Section 6, Township 117, Range 21, Hennepin County, Minnesota; thence easterly along the south line of said SE 1/4 of the NE 1/4 395.5 feet, more or less, to a point 790 feet west of southeast corner of said NE 1/4; thence northwesterly at an angle to the left of 116°02' to the west line of said SE 1/4 of NE 1/4; thence south along said west line to the point of beginning, which land is to be held and used for permanent open -space land for Park and Recreation, and WHEREAS, Title VI of the Civil Rights Act of 1964, and the regulations of the Secretary of Housing and Urban Development effectuating that Title, proved that no person shall be discriminated against because of race, color, or national origin in the use of the land acquired and/or developed, and WHEREAS, it is recognized that the contract for Federal grant will impose certain obligations and responsibilities upon the Applicant and will require among other things (1) assurances that families and individuals displaced as a result of the open -space land project will be relocated into decent, safe, and sanitary housing, (2) compliance with Federal labor standards, and (3) compliance with Federal requirements relating to actual employment opportunity; and WHEREAS, it is estimated that the cost of acquiring said interest(s) will be $241,196, and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ST. LOUIS PARK, MINNESOTA: 1. That an application be made to the Department of Housing and Urban Development for a grant in an amount authorized by Title VII of the Housing Act of 1961, as amended, which amount is presently estimated to be $120,598 and that the Applicant will pay the balance of the cost from other funds available to it. 2. That the City Manager is hereby authorized and directed to execute and to file such application with the Department of Housing and Urban Development to provide additional information and to furnish such documents as may be required by said Department to act as the authorized correspondent of the Applicant and the City Manager and the Mayor are hereby authorized to execute such contracts as are required by said Department. 3. That the proposed acquisition and development is in accordance with plans for the allocation of land for open -space uses, and that, should said grant be made, the Applicant will acquire and retain said land for the uses designated in said application and approved by the Department of Housing and Urban Development. 4. That the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, assured of full compliance by the Applicant with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964. 5. That the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, assured of full compliance by the Applicant with the Federal labor standards imposed under Title VII of the Housing Act of 1961, as amended.
